[Music] Hey guys, welcome back to Clownfish TV. This is Neon, not here with geeky sparkles in this video. I'm going to talk about TikTok. I'm going to talk about this TikTok ban. It's looking more and more likely like this could happen. A lot of people said, no, there's no way that they would pass this law to ban TikTok. And then people said that while some American company is going to swoop in and buy TikTok, but there are all kinds of problems with that. One is, bike dance will not sell the addictive algorithm. That's the biggest one. Apparently whoever buys them, it can't be like a Google or a Facebook or an Apple. It has to be a smaller company and I don't know, this might be the end of the line for TikTok. So for those of you who have spent all of your time on TikTok, I'm sorry. I remember when Vine was a thing and then Vine disappeared too, but Snapchat, remember Snapchat? Is anybody Snapchat in any way? I don't think anybody's doing that anymore. So these things only last a couple of years, usually. YouTube has been kind of the outlier, but let's talk about this. It's like the biggest social media platform with the Utes. With Gen Z, it's come from the New York Post. They said TikTok admits US ban is inevitable. If the court doesn't block the law. So TikTok and Chinese parent bite dance on Thursday urged a US court to strike down a law. They say will ban the popular app on January 19th, saying the US government refused to engage in any serious settlement talks after 2022. Legislation signed in April by President Biden. I just want to I want to point that out there for those of you who think that it's Trump. It was Biden gives a bite dance until January 19th of next year to divest TikTok US assets or face a ban on the app used by 170 million Americans. Bite dance says a divestiture is not possible technologically, commercially or legally. The US Court of Appeals for the District of Columbia will hold arguments on the lawsuit filed by TikTok and bite dance along with TikTok users on September 16th. What we'll talk about that TikTok's future in the US may rest on the outcome of the case, which could impact how the government uses its new authority to clamp down on foreign owned apps. Now here's where I am torn on it. I think TikTok was designed to be addictive and I think that there probably is some spying going on with TikTok. That being said, it sets a pretty dangerous precedent, I think, to allow the US government to ban a social media app because we know where that's going to go. You know, I have no doubt. It's like, oh, we banned TikTok. Okay. Well, now we're going to come for rumble and now we're going to come for this one and that one and whoever else we don't like, we're going to ban. We're going to put some laws in place and they're already trying to do something in New York where with social media companies, they're trying to say that, oh, if you've got minors on your platform, you've got to basically nerf the platform and adhere to these guidelines and that's what's going to happen. They're going to nerf all these social media companies. We have YouTube now. They're going to have community notes like Twitter has, like X has. I'm sure that won't be abused at all. I'm 100% sure everything will be above board. So, I mean, that's what kind of concerns me about this. So, the law is a radical departure from this country's tradition of championing an open internet and sets a dangerous president by allowing the political branches to target a disfavored speech platform and force it to sell or be shut down by dance in TikTok. Are you driven by worries among US lawmakers that China could access data on Americans or spy on them with the app, unlike Amazon, who never looks at your browsing history when suggesting ads to you or putting ads on your firestick. Like, hey, I just searched for that thing the other day. And as if by magic, here it is. Here's a commercial for it on my television. Wow, how did that happen? The measure was passed overwhelmingly in Congress to ban it just weeks after being introduced. Lawyers for a group of TikTok users who have sued to prevent the app from being banned said the law would violate their free speech rights. And filing on Thursday, they argued it's clear there is no eminent national security risk because law allows TikTok to continue operating through the rest of the year, including during an election year that the very president who signed the bill says is existential for our democracy. Do you think Gen Z is going to vote for Biden when Biden's the one that passed the law to ban their TikTok? I they probably will. I don't know. I don't know. TikTok says any divestiture or separation, even if technologically possible, would take years and argues that the laws run afoul of Americans free speech rights. Yeah, this one's dicey. I mean, it really is. I think it opens up Pandora's box. I do think that TikTok was designed to be addictive. I do believe that there are forces outside of the US using TikTok to manipulate young Americans because our TikTok is very different from their TikTok. I'm just saying it is and the stuff that they keep showing kids because it's so addictive and the algorithm is so addictive. So I do think that there is some something else going on with TikTok. But that being said, you know, once you open up Pandora's box, now every other platform the government doesn't like for whatever reason can be banned by the US government. You know, it sounds like something the CCP would do. I'm just saying. I'm just saying. Yeah, it says the law unfairly singles out TikTok for punitive treatment ignores many applications with substantial operations in China that collect large amounts of user data. By dance, recounted lengthy negotiations between the company and the US government says abruptly ended in August of 2022. I watched the the hearing back then and the CEO of TikTok was like talking to these these senators and they were like total boomers. I mean, they were they were just like, social media, bad computers are bad. I don't understand what it does. But bad just like when they were growing Mark Zuckerberg and he was just like, have you ever used a computer? God, you people are stupid. So the company made it public. They also made public a redacted version of the 100 plus page draft national security agreement to protect US TikTok data says it spent more than $2 billion to billion on the effort. The draft agreement including giving the US government a kill switch to suspend TikTok in the US at the government's sole discretion if the company did not comply with the agreement and says the US demanded that TikTok source code be moved out of China. This administration has determined that it prefers to try to shut down TikTok in the US and eliminate a platform of speech for 170 million Americans rather than continue to work on a practical feasible effective solution to protect US users. Wow. Yeah, so it's weird because Trump was the first one to talk about banning TikTok. And it was Biden who actually wound up signing that and it seems like they're just going to go ahead with it. So yeah, TikTok is like, yeah, we're going to get shut down if you go through with it. Now this is there were some creators filing briefs in a legal suit to TikTok ban. This is coming from the information. They said that TikTok is parent company bite dancing a group of create a group of creators filed court briefs on Thursday challenging the federal government's TikTok ban or sale law. So creators are involved in this too. The briefs disclose new information about TikTok's interactions with the government and argue that the law violates the First Amendment and the legally singles out TikTok. The arguments advanced largely mirror what TikTok has already said publicly but more than 800 pages of supplemental Doc 800 pages of supplemental documents TikTok also attempted to emphasize the extent to which it had been willing to work with the government. TikTok include a redacted version of the draft. We talked about that. They included one page document to the Department of Justice in advance of the ban which talked about the potential for the Chinese government to influence Americans or access American user data provide no examples of such a thing occurring the briefs are the first step in expedited schedule for TikTok's lawsuit designed to allow either side time to appeal. The government will need to file a response by July 26th and arguments are scheduled for September and they'll be banned in January. I don't know what to tell you if you're a TikTok creator. I don't know what to tell you. I think that it's probably really dicey now. I guess my thing is like if you're not on TikTok already, I would hold off. We see how this goes. I would definitely hold off. I think it's looking pretty dicey for TikTok. But who knows? They can pull rabbit out of their hat. I don't know. We have a TikTok but it's kind of on the autopilot.
