Kirby, just arriving. Thank you very much for stopping by today on this big debate day. Everybody's going to be watching this debate tonight. If for nothing more than entertainment value, get your popcorn. Let's go. Good morning, Jesse. Yes. Good to see you, buddy. Good to see you. You got to watch? Oh, absolutely. I know you lean a tad left, and that's... I'm a moderate. Yes, fine. You're kind of right there. So what do you think Trump has to do to win or lose it, and the same thing for Joe Biden to win or lose it? Let's start with Trump. You know, I think that they are looking for the moderate vote here. They've got the vote on both sides, right? So I think Trump really, against his normal way of doing things, should try to be presidential. Give people confidence that the things that went on that were distasteful to some moderates that he did in his presidency. You know, I've learned, I've grown, I'm more of a statesman now. Sand the edges, obviously will. I think so. And for President Biden, I think he has to just hold the courts. If he comes out looking competent and good, you know, he did a decent job in the state of the union address. If he does a decent job in this, I think he, you know, he gains ground. Does that mean the bar set that low? If he can just pull off sentences, then he's done a good job. It's set that low. Yeah, that's all. And you know, I'm concerned we won't see a debate. I want to hear him talk about issues, not yellow screen, right? Right. Get off topic of the question. Answer the question. All right. Let's talk about the Supreme Court. They've been making some noise, too, as yesterday we're starting to hear and nothing was supposed to have been released yesterday on a decision. Oopsie. They say they accidentally posted a decision to the website yesterday. It was taken down pretty quick, but Bloomberg News grabbed it and it's everywhere now. And this was all about the abortion issue. I believe in Idaho, right? So I want to get your thought because legal speak to me, when I read it and the decisions that have been made, I always think it's the opposite of what actually happened. Yes. So I'm going to read this to you. Of course, you'll get it, but I'm looking at this going. Okay. The prematurely posted opinion showed that the court will dismiss Idaho's appeal by a 63 vote, which would reinstate a lower court order blocking Idaho from enforcing. It's almost total abortion ban when preserving the health of the mother, depending on the mother depends on an abortion. So, okay, they reinstate a lower court's order blocking Idaho from enforcing. What happened? So it's the process. So you have this law that Idaho passes as a big abortion ban. It goes to a lower court, not the Supreme Court, but an intermediate court. Okay. That court says you can't do this. You can't block this law, can't prevail. You can't have a total ban on a abortion. That's right. That's what the lower, the intermediate courts. Okay. Then it goes up to the Supreme Court. Who took it? Idaho took it to the Supreme Court because they won a total ban. That's right. And the Supreme Court said, well, we don't know what they said yet, but there was an inadvertent, leaked opinion where they appear to be agreeing with the intermediate court and blocking the total ban. So then that term upheld means we're letting the lower courts opinion stand. That's right. Yeah. And so that's what's happening here. But you know, JT, the Supreme Court, good grief, you know, they leaked Roe, the Dobbs pinion. Right. Now we see this. We've seen all the spending things with the Supreme Court, you know, with some of the justices. You know, it was a leak accidentally or a leak intention. It almost looks like they're floating balloons to see what public opinion looks like. And I ain't even think that, but good grief. You know, I think I'm pro-life. I think that in an abortion situation, if the mother's life is in danger, that's the first priority. So if there's something going on that could kill the mother, then I think you've got to address that and alleviate that issue. And if that means you've got to abort the baby, you know, I think that's where I stand on that. I think mother comes first in that. Sometimes there's just no good answer. I know. It's a horrible thing to be faced with. It is. And I would hate to be the one making that decision, but I got to say I probably agree with you on that. I agree with you. Let's talk about something else that is going on. I thought this was interesting. Well, I am concerned that we are dumbing down the bar exam that we are dumbing down law school. You know, we live in a world where kids are smarter than I was growing up. They have more access to tools to be better educated and better informed than we've ever seen. The bar exam should be getting tougher. Why are we lowering it? Bottom line, don't shade it. Don't cover, don't sugarcoat it. Why are they doing this? I think there's just a lot of pushback on how difficult the bar exam is because it is very difficult. I think it should be. And I think they're getting a lot of pushback from a generation of folks whose feelings are bothered by the difficult. The width of vacation of America continues. It was three days when I took it. How long? And they're wanting to kind of just soften look. We can't be so mean-spirited. We got to let more people in and- Oh, come here. Give me a hug. I'm sorry. We're so tough on you on the test. That whole attitude is not preparing young people for the reality of the harsh, cold world. You are taking on people and businesses, problems, concerns, things that alter people's lives. You better be competent to do it. Look, you start doing this and then put these people in law firms are out there in the courtrooms arguing cases. And they've got somebody across the aisle that's on the other side on the legal battle in that courtroom that's actually done their due diligence and stuck with the original way to pass a bar. They're going to get shredded. That's correct. Yeah. That's right. And somebody is going to get hurt. That's what worries me. As somebody that runs a law firm, if this comes through and you start seeing a class of people that have gone through this softer bar exam, is there a way to interview potential employees for your firm to figure out whether or not they meet the standards of what the bar was like when you took it versus what they took here. Very difficult on the front end, but they'll say that you hire slow and fire fast would apply. Okay. I think I read you on that one. All right. Thanks Kirby. Good to see you buddy.
