So, not too hot. So, it comes in and then it moves out. Yeah, but it'll be cloudy today. That's okay. Yeah, I have a bunch of construction at my house and the ciders are coming today. So... This is Becca from New York City coming to you from a beach in Valencia, Spain. I'm here for a month with my husband and three and a half year old. And I had to take you all with me. Thank you for everything that you do. And I hope you guys had an awesome summer vacation as well. I love Spain. Oh, Spain is beautiful. I mean, Randolph's not as nice as Spain, but I did okay for my summer vacation. Yeah, you're really spending your entire vacation in Randolph. Listen, the amount I pay for rent might as well get all the use of all 900 facilities. Oh, that's facilities. You don't want to do when you go home at night, right? Yeah. You settle down on the couch, like place some music from other parts of the world. Yeah, and then you'll kind of feel like you're there for a couple minutes. I have like the TV. I can put like beach, a beach scenery on there. Oh, yeah. Like your sounds of the ocean. You could drive to the beach. There are beaches in Massachusetts. Yeah, I mean, that are free. I'm really close to a lot of beaches. Of course you are. Self-shore beaches. Yeah. Just all night waiting. You live in Randolph. Yeah, I do. You're not going to change anytime soon. You're in Randolph. That's our second call from Spain this week. Yeah. That's pretty cool. Every time I hear Spain, I think about this clip. Elaria. Because the funnier is actually Hillary from Boston. Yeah, Elaria. Maybe she'll run into Hillary from Boston. So the Karen Reid hearing was yesterday and I guess the trial is going to happen in January, Donovan? Well, we were hoping that it would be like mid-winter. Yeah. Because there's nothing going on in this area mid-winter. So that was actually kind of a good thing. Yeah, and Katharine Loftus is coming in. We have a lot of questions. Yeah. Well, a lot's happened. I mean, besides yesterday, we've had jurors come through. And then we also have had appeals written. So we've had lawyers added. So there's a lot to talk about. And also there were a lot of protesters that were against Karen Reid. Yeah, both sides yesterday. Yeah, it was glaring how big they and loud they were. It's interesting how now people are coming out. I think they were kind of quiet. They were like the anti-Karen Reid people. But now they're like, they're front and center. Yeah, and I wonder what the shift was. Maybe they didn't go through the trial like that. Well, maybe the prosecution went out of its way to solicit for people on the prosecution side. Do you think they're paying for protesters? I don't know. Billie has a conspiracy about protesters that they're all paid. Oh, there are professional protesters that go. Oh, that's definitely happened. I didn't know that one. That's a sign out. So I will protest anything. But maybe not in this place. It's like money. Yeah. But you know what? It's not good for the people who stand outside the court. It's going to be biting cold in January. It will be. They're going to have like heaters and like, you know, bond fires across the way. Oh, you know, the barrel with the fire in it. Everybody stands around the barrel like the old union fights, you know? Yeah, they'll be out there though for sure. Oh, yeah, they'll be out there. Dedicated. Olympic Games are coming up Friday with opening ceremonies. Yesterday they named LeBron James. He's going to carry the US flag in. I think it's a good choice. I thought that was good too. You know what? I really think it's a good choice. Do you think it will be his last one? I mean, he's close to 40. So I was probably going to be laughing. I think so. And I think that may have played a part. But yeah. And I should mention, I'll talk more about this coming up in the entertainment. But iHeart is going to be very involved with the Olympic Games. Yes. There are rumors that Lady Gaga may perform or might perform at the opening ceremony. Yeah, we found this in Variety. Several people posted it yesterday. She's in Paris right now. So that'd be cool. Yeah, I think it should be a good painting. I think it should be amazing. And it's going to be on the banks of the sun. The whole sort of opening ceremony. It's going to be really magical. Oh my god, yeah. I can't even imagine what that would sound like. [MUSIC PLAYING] There she is. Good fact. [MUSIC PLAYING] Live from Paris, France. You know, I can never look at the river send the same after seeing that movie under Paris. See? Like, if I go to Paris again, I'll have to avoid the send because of the movie. By the way, with regard to the Olympic Games, we mentioned this a couple of minutes ago, "Aihart Media" going to serve as the official audio partner of the Olympic Games, providing hourly updates from Paris on all Aihart stations, including Kiss 108. That's great. You know that I'm thinking about going to the Olympic Games? Oh, could you want to be-- Yeah, I'm thinking about taking the channel, which it goes from London to Paris, selling a couple of hours. Oh, yeah. And then we can make it go to one of the events. Speaking of Paris, France, the first trailer for season four of the show, "Emily in Paris," is out. Season four, part one will debut August 15, part two, September 12. So it's going to be in two parts. I love the show, but it annoys me because it's a very quick watch. They're 30-minute episodes. And I can do it in like three hours. Well, you've got to have to pace yourself. And then I'm lonely for a year and a half before it comes back. I'm in love with Gabrielle. Oh, gosh. He's so handsome. I'm an elfie girl. I'm an Alfie girl. Oh, yeah. I love Alfie. Yeah, Alfie's cute, too. They're both him. I mean-- Gabrielle is just-- yeah. He's dreamy. Somebody in the show is named Alfie. Yeah, her British boyfriend. Who's the same as Lucian? Oh, my God, he's so hot. Yeah. Wasn't there a song, "What's It All About?" Alfie? I don't know, but I did pull a clip of the trail there if you want. I was pay that. Oh, my God. Mindy, do you want to sign my run? Hot men. Everywhere. I guess I've just been so focused on Gabrielle and Alfie that I forgot what it feels like to be single. Would I like this show? Yeah, you would. I think you would love it. But do you know that Alfie, Lucian, is dating Shakira? Yes. I didn't know that they just did an ad recently together for Gucci or something. Who did? So Madeline Klein is in the show, and so is Camilla Mendez from Riverdale. OK. And it hits theaters July of next year. And Sam Smith recently tore his ACL in a skiing accident. He talks about it. I broke my ACL, completely ripped my ACL. What's that? It's like a tippity as a football injury. Yeah, it was skiing. Right. It wasn't an idiot. I went on a black slope on the second day. Oh, Sam. Oh, no, but I was quite good. Yeah. And she was like, you can do it. I did it. Can do it. Correction, they tore their ACL. There's only one of them, but they tore their ACL. And by the way, Sam, you don't break your ACL. You tear it. Yeah. Well, Sam didn't follow the correct procedures. Be sure your bindings are firmly fast. We don't want any loose skis to spoil the fun. I went on a black slope the one time I went skiing. I have to be on the bunny hill for about 30 minutes. Yeah. And I broke my ACL. Yeah. It can happen. That's a bargain. There's nothing more terrifying than accidentally winding up on the black trails. Yeah, and you never want to have to come down in that toboggan. The toboggan was scary because they wrap me in it. And then they tied me to one of the worker's skis. Yeah. And they skied down with me behind them. It's one of the most humiliating things you can do in life is to be taken down in the toboggan. I was also about 360 pounds. Oh, my goodness. It didn't help either. Wow. That was-- It was so quite a trip down. You look like jelly roll coming down in the toboggan. I rolled down that line. Wow. I don't know why they even need the toboggan. They could just push you. You can push me right now. Like a giant snowball, right? Really, you were that big? Yeah, that was my biggest-- 360, you clocked in? That was my highest weight. But I love that you went skiing. That's so awesome. Yeah, it's our own little jelly roller. We're sleeping on the Boston common to be and taking down in the toboggan. What a life. Chris Brown is being sued for ordering a beat down on some guy at a show in Fort Worth, Texas. Justin, this is a $50 million lawsuit. What the hell happened? I lost some guy. I got backstage and I went up to Chris Brown, said hi. Chris said hi to him, didn't know who he was. And one of the Chris's guys said, hey, remember? You had beef with this guy and like a mafia boss. Allegedly, he ordered 10 of his guys to beat this guy down. So it was like, Chris, you don't remember this guy? Yeah. Imagine his tune completely flipped. He was talking to the guy, saying hi to him. Thanks for coming to my show, and then all of a sudden, beat them. But the thing is to me, if his people knew they had beef, why would they let him back to begin with? And he had no idea. Clearly, he was being nice to the guy. Like, hey, what's going on? But thanks for coming. It's a great point. I don't know. Imagine the guy, guys high five and eight Chris, great show, good to see you. And they say, hey, Chris, don't you remember that, dude? Beat the spit out of him. 10 Black dudes just beating them down. Zack Bryan's girlfriend Brianna says rumors of being drunk and turned away at Fenway are false. She says he never even got to Fenway part, Zack Bryan. He lost his voice after a show at a Gillette Stadium. Zack Bryan says, stop making stuff up and stop being weirdos, Winnie. [LAUGHTER] Listen, I don't care. They still don't fall into an Instagram. There's something that happened that they unfollowed each other. I don't know what it was. But something happened in those few days. Now, I do think men make up much more crooked than women. Uh-huh. And we've got a pair of tickets to see Meghan Trainor. Now, Meghan is coming back home. She's coming to town. She's from Nantucket. And that's why Collar 25 at 617-931-1108. And then be like, OK, go. But my husband and I, we pee together, though. And we hold hands and we-- he sits when he pees. And we're like, what are we doing today, baby? And we have a calendar in there. And it's very cute. And it's like my favorite time. OK. OK. With this made up, was that a doctored tape? So they have two bathrooms, two toilets. And they-- well, she sits, he stands, they hold hands. No, he sits and holds her hand. Oh, he sits when he pees? He sits down to pee and they hold hands. And they've talked about their day. And Catherine Loftus is in studio. And a couple of things have happened in the last couple of minutes. A, Winnie knocked over her entire cup of coffee. I'm sorry. What am I going to do? I was not early this morning. We can make you another one. And B, you just smashed yourself in the face with your headphones. So welcome back, Catherine Loftus. Move me a little slow this morning. Two weeks in me, and I'll do that to you. Lisa and Donovan and Winnie have a dozen questions, but I'll just ask one simple question. Why are they wasting money on another trial? Well, the Commonwealth thinks she did it. So they're going to go forward. The question is, what are they going to go forward on? Which charges? Because that's the subject of the motion to dismiss that we're going to have on August 9th. As we've talked about, I've always been of the persuasion that if they're going to retry it, they should drop the-- Right, if she was overcharged. And it feels a little bit to me, like everybody is so entrenched in their sides that the DA's office is just going to double down and keep the second to create. They should just dismiss it. You think they will, really? They shouldn't. They shouldn't. At least going to have a different prosecutor, because let's face it, that guy really needs a different job. The really interesting thing is, since we didn't have anybody yesterday, my guess is we might not. It might just be the same to Adam Lally as well. I think it's Laura McLaughlin. And for as much as we all, from the outside looking in, didn't love the way he presented the case, what we're now learning, though, is that at least on some of the charges, they leaned more towards the Commonwealth. On the manslaughter, they bought what the Commonwealth was selling, the majority of them. So he was doing something right. Maybe it was not effective to the public watching it, but it was different in court to the jury. Can you explain Marty Weinberg? He's a new attorney that's been introduced into the case. What will his role be? So he's come in for the limited purpose of filing the motions to dismiss. So they've filed the defenses filed to dismiss counts one, which is the second degree murder, as well as counts three, which is the leave in the scene of death. And basically, what they have said is we have information from certain jurors that they came to unanimous decision. Now, Marty Weinberg is a criminal defense attorney, and he also does appeal. So he's brought in, basically, for the purpose to prong. One, you almost have to-- a pallet attorney's kind of throw the trial counsel under the bus. There were issues. They didn't object to the mistrial at the time. They didn't ask for the jury to be pulled. So things that Marty Weinberg and his motion is asking for now. And secondary to that-- both David Unity and Alan Jackson, in a way, have become witnesses, because they've had first-hand communications with the jurors. So it's difficult for them, themselves, to argue to the judge the information they've received. You basically bring in somebody else, you submit the affidavit from Alan Jackson to David Unity, and then Marty Weinberg argues. But I don't think he'll be staying on the case for the long term. But do you think that this has merit? Do you think that they'll be able to get one of these thrown out, or two? I don't, legally. And the difficult thing, there's a lot of frustration about this, because realistically, if they came to a decision, if they would 12 and 0 on anything, she should have gotten that verdict. They should have come back and relayed that to the court, and then the judge could have taken those two verdicts and declared a mistrial. The problem with trying to come in on the back end and do this is that we really don't want situations where we're inquiring of juries later, where we're bringing them back and saying, what were you really thinking in there? Were you 12 always? You'd have to think about it the other way. What if they were 12 and 0 guilty on the murder, and they didn't come back, because it was split on the others? So the precedent that it sets is not one that we want to, and I don't think that the law is on this side. I do think that the Commonwealth should just drop the second degree. But like I said, I don't think that they're going to do that. So what's Karen Reid been doing during the long break? Should go to the Hamptons or something? I always wonder, all of a sudden, she's off the map. Well, it is funny, because there was so many sightings, and there was so much publicity. And it has died down a little bit. We haven't seen where she's been. I mean, I've been on vacation, so maybe they've been sightings. I heard she was a J-Lo's birthday party right now. She saw her house. That's all we know, right? Oh, yeah, the house is listed. Yeah, the house is listed. And now, I mean, the January date, it's not till January 27th is the next trial date. Which we love. I know, I mean, it's in winter, so we're not-- we don't want any much going on. Well, and you know what the nice thing is, too, is because if it is going to be a long trial, again, the court has to think about-- she talked yesterday about she knows whatever decision is going to be made on the motion dismiss, one of the parties is going to appeal it. So she's allowing for the time for the appeal process to go, you know, to at least be started. And we have Thanksgiving. We have Christmas. So you don't want to unpanel jurors, then. Do you think that this Netflix series that was announced will wait until the second trial is over? I'm guessing no. I don't know. I feel like they'll probably come out mostly just because there's so much hype about it. I feel like maybe somebody wants to get in on the front end of it. But it's hard to know, you know, it's hard to know. Well, they're smart. They would do one now. And then the other one. And then the follow-up. Yeah, and they said it was-- I think they said it was like about the lead up up to. So it'll be interesting, kind of, the perspective that they take. So will we still see the pink and the blue people outside the courthouse? It's going to be very cold out in January. You know. Which could limit your question. You know, maybe somebody should do some, like, limited edition, like, puffers. He didn't tense. We said earlier, maybe they'll be standing around barrels with fire. I mean, it's pretty cold in January, especially at five o'clock in the morning when we were supposed to-- Yeah, well, see how dedicated they really are. Yeah, that's a good question, Billy. I was a hearing to decide where to go forward, how to go forward, what happens next. Before we get to the phones and the chargebacks, Lisa, Catherine Loftus, going to be at your book club. She got a $50 ticket for beeping at the Caron Read supporters. Is that common? Is that surprising? Yeah, for beeping. I would like to see what the citation-- what the statues. Disturbing the piece, what? Yeah, she's saying. Has she got it yesterday? Well, I don't know if she's yesterday or during the trial, but she talked to Riley. He said that she caught a $50 ticket for beeping at the Caron Read protesters. Wow. Well, we're going to have to look into that. A little overzealous police in it. What's that? What else they're going to do? Everybody's yelling and screaming at each other out there. Justin, talk backs. Just a comment about Caron Read. She looked so serious yesterday and a bit worn down. It's kind of crazy that this is all going to happen all over again. I mean, it's a lot for a person to handle. Yeah. Yeah, I think it's-- probably most people noted that she appeared much more serious yesterday and more somber. And I think it's not only probably-- you're kind of on the high where you're in the midst of the trial. There's a lot of-- you have this constant adrenaline running. And then when you don't really have the outcome that you expect it and now you have to go through it all again. And it's not for another five months. That way, as on a person. What do you think inside her brain when the verdict was read? Do you think she was surprised at the mistrial? I think that they were-- at that point, the fact-- once they came back with the three notes, I think they all knew and expected it was going to be a mistrial. I think when they closed, I think the defense probably thought that they were going to get not guilty across the board. So I think it didn't appear outwardly as disappointment. But I imagine they were probably disappointed. Do you think that this trial in late January will last as long as the previous one? I hope not, Lisa. [LAUGHTER] Well, that all goes to whether the Commonwealth decides to go on the second-degree run up. Because again, most of what we heard went to that charge. All you have to prove, theoretically, if they were to dismiss or null-prost the murder charge, they don't have to prove intent. They don't have to get into a state of mind. All they have to prove for the manslaughter is that she was reckless and that she was intoxicated. So you actually can skim down the case quite a bit. So it's really going to ride on what the Commonwealth decides to move forward. Do you think there'll be as much national attention on this story in January? It's hard to know. Probably, I get the feeling that it might be even more divisive, because as you were talking about, I feel that both sides have come out a little bit stronger. There were more people on the O'Keefe side and being vocal. So I think that we'll probably get just as much attention the second time around. Hey, is anything ever come of that woman that basically attacked Turtle Boy? You remember that scene on the street? Oh, Jill Daniels. Yeah. I don't think she was charged. I actually heard something happened in the Cape a few days ago at a restaurant. Oh, I heard those like that. Oh, really? Whoa, whoa, whoa, whoa, whoa. I'll give the room a story. Oh, I'll say it again. Allegedly, she was down in the Cape with her voice. This is Winnie TMZ. Who is right down on the Cape? Jill Daniels, who is the sister of Julie Gaines-- The same woman. --who is married to Chris Albert. They are Colin Albert's parents. So she's essentially Colin Albert's aunt. She's also friends of the Proctors. So she's all in this. She was down in the Cape. And I guess someone recognized her down at a restaurant with her boyfriend. They exchanged words. She called the manager of the restaurant an old hag. And then she used a very, very bad word you use towards women to two of the waitresses. And there was a lot-- and there was a lot of witnesses to this. Oh, so she's a brawler. And then it happened. She seems to be a little melty. Yeah. She should look into the UFC or something. [LAUGHTER] Allegedly, we do have an anonymous on the phone. It's the lead that had the ticket for the beefing, so we can get-- Oh, good. Oh, there she goes. Leading on the horn again. Yeah. OK, anonymous. What's your story? You really got a ticket for beeping? Yes. Back in April, when I drove by the courthouse, there really wasn't protesters out there. I beat the horn. And after I left, I was at a red light. I got pulled over. And I said, why am I getting pulled over? He said, I'm really use of the horn. You can't see from front of the courthouse. So I said, OK, he gave me a written warning. So that was in April. So that Friday of the verdict reading, I was driving by my daughter. And we passed the courthouse. And we were down by the church where all the-- Karen, we supported her. And we two did. They were going crazy. We were supporting them. And two weeks later, I have $55 a ticket in my mailbox for, I think, the same thing, the horn. So it was a happy horn. Quite that. You should appeal that. How are they going to prove that you drove? Right. He was a driver. It was a happy horn, not an angry horn. Do, do. With a happy horn. And the crowd appreciated it. And to appeal the ticket, it would cost me $25 just to appeal it. I know. That's how they get you. So wait, is it-- if it's a moving violation, appeal it, because you don't want it on your record. Trust me. Yeah, I want to appeal it. And by the way, anonymous, we do have a lawyer in-house, so-- Well, that's the problem, is they get you with the fees for the appeal. So a lot of people do what you are thinking is that, oh, it's not even worth it to put in the appeal. No, it's worth it. But I think that sounds pretty outrageous. I think so, yeah. Was that how it would appeal it? Yeah. I would fight it. Yeah. Right? Justin would have gotten there. Yeah, 100% fine. Just for the principal. Yeah. Hi, Catherine. Do you think that the push back to January will work in the defense's favor in terms of picking another jury, because it seems like still a lot of people still know about this case and are still talking about this case. And a lot of the public seems to think that she's innocent, so do you think that that'll work in the defense's favor? I think time will work in everybody's favor a little bit to, you know, let's get through the holidays, have things calm down. I really-- I know it's difficult, I think, for all of us who are in it to imagine that there are people who aren't paying attention to this, but I was just at a birthday party over the weekend. And there were, like, a handful of people who said, oh, I know her name, but I'm not paying attention to it at all. So you would actually be surprised. Again, it's going to take more work. It's not a regular jury. You're not going to get 12 jurors. 16 jurors right away. But you will find them. And I think it will be beneficial to both sides that there's a little bit of time for, you know, kind of, hopefully, the, you know-- I got to tell you, I was on vacation. Everybody was talking about it still. Everybody, what's the latest on Karen Reed? So when's that coming back? Well, it was back yesterday, and now it comes back in January. So what will they do in August 9th at that hearing? So August 9th is the motion to dismiss date. So that's-- attorney Weinberg's going to be arguing that. So that's about whether to dismiss counts one and counts three based on the, you know, the not pulling of the jury, the fact that the jury now says that they were unanimous in some of the verdicts. I think it's likely going to be denied. They'll appeal it, which is why she allowed for kind of a, you know, a stretch of time before the trial begins, because she basically wants them to deal with it in the appellate courts before we get to trial. Justin. Good morning. This question is for Catherine about the Netflix documentary. Do you think Karen Flers will try to stop it? Because depending on how it's portrayed, it could really sway a jury? I'm not sure that they have the ability to stop it. I don't know why, well, I mean, what grounds would they have to stop an independent documentary trial? This way, public opinion, she's right. Right, but I mean, that's part of, think about it this way. Part of their defense has been, you know, putting everything out in the public in an attempt to sway public opinion. So I think that the, the Netflix series or whatever else comes from it is just like adding on to what we already have. I would say the vast majority of this case is being tried in the public already. So I don't know that one documentary along can really sway people one way or the other. I'm still of the persuasion that people really, that everybody has their positions and nothing. Nothing's gonna change that, you know, no matter what you see. - Wow. - I have a quick question about the jurors. So we had four or five come forward anonymously. They are saying basically the same thing. Do you feel like that, at the end of the day, it doesn't really matter what they're saying because they're just gonna go off of what happened with the ruling originally? - So do you mean that it doesn't matter what they're saying in terms of like because they were, you know what I mean? - So in terms of the appeal, you know, and like I said at the beginning, it's hard because we want, if they had rendered a verdict, she should have gotten acquitted. If they were 12 and O on the second degree and they'll leave in the scene, she should have been acquitted on those. The problem is they didn't tell the judge that, they didn't inform you. - Right. - Why didn't they? - That's, I mean, that's the question. And the problem is we can't create the system now where we go back. We would say, okay, now we're gonna bring everybody back and say, hey, why didn't you say it? And were you really, you know, was everybody 12 out? Okay, and if you were, let's render the verdict now because now everything's been muddied up by the fact that they are exposed to media. They know what's happening. They're following the case outside of it. - So in January, is it gonna be even more difficult to seat an unbiased jury? - I don't, you know, I don't think so. I think it will just take time. I think it just takes time to weed through. I think we had 200 to 250 that we went through this time. It took us two weeks to get a jury. It'll probably be the same thing. It's going to be an extensive process, but they'll find a jury. - Absolutely, like you said, there are a lot of people that couldn't have, they didn't have time to follow it. - Well, and that's the funny thing. Most people, the people who don't follow it are like, I just didn't have the time. - Right, yeah, yeah. - Probably better on it because it's a lot. - Justin, talk back. - We're the Karen retrial. It's really interesting because I've only heard about it from listening to you guys on the radio. I literally have no idea what she did or what they think she did. All I know is that there was a car and her boyfriend was a police officer. So maybe I'm the perfect juror. - Yeah, see, that moves our point. - You don't have to, we don't have to find jurors who've never heard of it, just that they haven't been following it. They don't know, you know, most of the information that they can be fair and impartial. So I think that you'd be the perfect juror. - Well, for the listeners who are hearing about it for the first time, why don't we take them back? What happened and why? - So the allegations are that on the 9th of January 28th and to January 29th of 2022, Karen Reed, John O'Keefe, and a number of other people were out drinking at different bars. The Commonwealth alleges that they were on their way back to 34th Bay of U Road for a party at the house that John got out of the car at some point and that Karen is alleged to have backed into him, left him to die in the snow. The defense has been that she never hid him, that he in fact went inside the house, that he was beaten inside the house and then left, you know, dragged outside and left to die. So it's pretty different theories. - Wow, it's a crazy case and it's captured the attention of the country. It's bizarre. It became, toward the end of that trial, it became the number one story on National Television Show. - And it's interesting. And that's why I think there might be, you know, a lot, just as much the second time around because there was so much local attention, but it really only started to go national regularly towards the end and once the verdict came in. So it'll be interesting to see what happens in January. - Okay, so going forward, what is happening in August now? - So August 9th, we have the motions to dismiss. She'll probably rule on those, I would say within a week or two of the hearing so that they can appeal any decision. And then we're gonna wait until January 27th. They'll have a status date or a final pre-trial conference date for that. - So would you come in on August 10th? - Sure, if you don't have me. - All right, in the meantime, where can people get you?
