(upbeat music) - Better strap yourself in. It's time for the Howie Car Show. - And they have to whitewash Harris' background, but I think we've all seen her. I mean, she's incredibly vapid. - Dude, I love Venn diagrams. It's just something about those three circles. - And she doesn't have any accomplishments. - In the United States of America, where we are manufacturing electric school buses and they are really cool. - The vice president didn't tell you it was America's biggest electric bus company just went belly up. - Live from the Matthew's brother studios. - Clearly, there was never an intention to show disrespect to any religious group. - Now go away or I shall taunt you a second time. - One of the drag queens from that controversial last supper parody, doubling down as backlash grows. - I'm carting your dinner direction. Your mother was a hamster and your father smelt of delivery. - Rump swabs, hacks, and moon bats beware, it's. (upbeat music) Howie Car. - 844-542-42 and, you know, we've been concentrating mostly on national news. The last few days, few weeks, but there is local news on Beacon Hill. It's all bad news, whether it's illegal aliens or Karen Reed trial, or there's a terrible bill that has been signed into law. It takes effect on August 1st. It's for lack of a better term, we'll call it by its number, House 4885, House H 4885. And it was signed into law by Mara Healy last week, I believe, and it's a gun, it's a gun grab bill. It's, I believe, totally unconstitutional. It violates everything in the Second Amendment. And we've been wanting to talk about it and it's time to let people know what's going on. A lot of people, obviously, most gun owners already know what's going on, but everybody needs to know this. This is aimed at everybody, every free citizen of the Commonwealth of Massachusetts. Joining us now to talk about this is Toby Leary from Cape Gun Works. Toby, thanks for being with us here on The Howie Car Show. - My pleasure, Howie, thanks for having me. Why don't you just give us a brief clip notes version of just some of the bad parts of this bill. And if you want to talk to Toby, I know a lot of people have been texting in and they've been saying they've been trying to get you at Cape Gun Works, but I assume you and your staff have been overwhelmed these last few days. - It's madness, to be honest with you. And I appreciate everyone who's been so patient. It is very, I mean, honestly, the staff is at their weight's end and they're trying to do the right thing by everybody, but it is really unprecedented how we've seen this. And we knew it was coming. I had a year, I've been shouting from the rooftops for a year telling everybody get what you want now. But I understand- - Right, no, and I know that I've, you know, driving around on the Cape last summer. You know, I knew, you know, the closer I got to Cape Gun Works, the more the signs I saw out there. You know, that you were putting out there and everybody else was putting out there saying, you know, call your reps about this legislation that was coming down the pike. - Right, and I think, you know, honestly, a lot of people were just blown away that this actually happened because the true story is, Congress doesn't even have the constitutional authority to do this, how that's the one thing that most people don't realize. Think of it if they did this to any other of the Bill of Rights, like issued a license to go to church or required certain background checks for, you know, the Fourth Amendment protections against illegal searches and seizures. - Right. - Nobody would ever realize it's happening until it's too late. They would never say like, oh, this could happen. - Or the Sixth Amendment. Karen Reed didn't have the right to confront her accusers. - Right. - Right, I mean, that's just another one. But they're all there, they're all there, you know, or you had to get a license to print a newspaper. - Right, exactly. And no one would believe that it's even possible, except we're kind of in Stockholm syndrome where, you know, for the last 40 or 50 years, especially in Massachusetts, we have really given power to people that they don't have. Like there's constitutional limitations to what they can do, but they do it anyway. It's called abusive power. And I really called them out on it in this bill the last year, but they just don't care. They just listen, oh, that's nice, yup. And they go and vote anyway, because there's constitutional immunity. They can't be sued or held personally liable for what they do every time they break their oath of office, unfortunately. And really the only way to make this right is at the ballot box in November. And we have a plan to do that as well. But just a couple of the things that really this does is it puts Massachusetts in the top spot for the assault weapons ban stuff again, because they didn't like being playing second fiddle to California, New York, New Jersey, Illinois. So we are now the king of the assault weapons ban. We have new features that make these guns called assault weapons in ways that no one ever dreamed of. - Such as? - Such as the shroud that protects your hand from being burned that goes around the barrel. Or we used to call it a stock or a foreign. Every hunting rifle, every rifle has one, Howie. So what they're saying without saying it is they want you to burn your hand as you shoot your gun. And to hold the barrel as you shoot your gun so that after two or three shots, it gets red hot and burns your hand. That's what they're saying. And if you have that, that's one of these assault weapon features. Another one is a pistol grip. - What if you have one now, was it grandfathered in? - Yes, it'll be grandfathered in now because it's prior to this eight, one date. And so that's one of the, they always try to be so kind to us surfs and peasants that they're gonna allow you to keep what you have, Howie. You're just not gonna be able to buy what you want going forward. So innovation always works towards freedom. So there's gonna be companies that will come up with guns that'll slide through. And thread the needle and be able to be sold. And there's already a few out there, but that's just one of the things. They're trying to virtually eliminate every semi-automatic rifle that is in manufacture today. And the craziest part of this, Howie is normally, they have to enumerate guns in a band. Well, they've just given power to this unelected board, which I don't know how this complies with the chevron deference that just got stripped from by the Supreme Court. But they've given deference to this board that says, hey, whatever gun you feel should be on the ban list, you can add it at any time. - Is this a state board? - Yep, yep, and they're doing the-- - Well, who appoints the state board? Let me, I can guess, but why don't you tell me? - No, it's a great question. And right now there's something called the gun control advisory board, which has members from the Second Amendment community, like the gun owners action league. There's some lawyers that are pro-2A that sit on that board. They're scrapping that whole thing and replacing it with this new assault weapons advisory board that-- - Assault weapons advisory. So in other words, they're just stacking the deck by even calling it assault weapons. - Oh, oh, yeah, this is-- - Yup, no doubt about it. And they, and so-- - It's like calling, renaming the First Amendment, the hate speech amendment, right? - Yeah. - And the governor gets to nominate somebody who is well-versed and get this. If this doesn't tip their hand, the governor can nominate someone on this board who is well-versed in gun safety. So you know what that means? Gun safety expert. So that's gonna be the Gabby Giffords, the Bloomberg, the Brady law, the mom's demand action. They'll all have a seat at the table. And so the governor gets to appoint one, the attorney general gets to appoint one, there's a bunch of other elected officials that get to appoint one. And by the time they've stacked this deck, there's gonna be no pro-2A representation on this board whatsoever. So, and that's all by design. - The Assault Weapons Advisory Board. Okay, so that, okay, so that's, they're gonna make the calls now. Unelected. - So yeah. So basically, any gun that does slip through the cracks and gets by because of the, they don't have all the evil features that they've now identified as an assault weapon. So if someone makes a gun that will slide through, guess what? All they gotta do is pick up the phone, call the board and say, hey, that gun slipping through the cracks, make sure you add it to the list. And they'll be like, on it, just like Twitter 1.0. And they'll, you know, rubber stamp it on to the, you can't buy list. And, you know, they're just really trying to make sure that you can't buy whatever gun you wanna own, which is totally unconstitutional. It violates so many Supreme Court decisions. - The textors are just saying that, you know, you should go, try to go into court and seek an emergency restraining order, a temporary restraining order, something like that. Why can't you do that? - There's a manifold prong approach right now where we're trying to fight this. The best approach in my mind, right? Now is the ballot referendum. So we did a little press release on Friday. If you haven't seen that, you can go to my YouTube channel and watch it. And it's called the Next Steps for 48.85, what we can do. This'll raise a grassroots army of people seeking signatures. And it'll put a stay on this law from being enacted until the election. - Wait, isn't it too late to get signatures? Now, to get it on the ballot, it's not? - No, because it's a referendum. It's not a ballot initiative. So because it's a lot-- - But aren't they about to print the ballots? I was talking to somebody last week. Aren't they about to print the ballots for the, oh, this would be for the primary though, I guess. So it's not too late for the general? - No. And if we get 50,000 signatures that are certified before 30 days from the November election, then it's on this year's ballot. If we don't get all 50,000 in time, so it has to be 30 days out. So if it bleeds over that 30 days from November 5th, then it goes on the next year's ballot. But guess what? That gives us a year of reprieve from this or another 15 months really from now. So where this won't go into effect until it's voted on by the people. So this is good. Now two things. One, yes, we have a lot of faith in the voters of Massachusetts. - We're going to have to take a break, Toby. What are the results thus far? - After this weekend's events in Paris, how do you feel about Boston losing out on the 2024 Summer Olympics? I'm saddened or I'm gladdened. - I'm gladdened. - I'm gladdened has 95%. - Okay. - 95% are stone-cold masochists apparently. All right, 844-542, 42 with us is Toby Leary. He's one of the owners of Cape Gun Works and he's talking about this new, horrible, unconstitutional draconian bill law that was signed into law by Mara Healy last week, H4885. And someone wants to know 617, can a friend from a free state transfer has non-compliant firearm to me here in Massachusetts? - Only if he overnights it at this point 'cause it's gonna be here by Wednesday or Thursday at the latest in order to be considered grandfather day. And so after that, the door closes pretty hard on the state until we get this referendum filed, then hopefully we'll have some reprieve up until the election. And so that's definitely gonna be a challenge. - So even if we don't get the 50,000 signatures, there's still a stay on it until after the vote in 2026, I guess. - Right, yep. So if, and honestly, it's gonna be tough to get 50,000 signatures up until 30 days out from the election. So it's probably gonna leak into that 30-day window, which is gonna bump it to the next election anyway. - But it's probably, it may be even better to keep it at 2026 'cause that's a year when they, it's not a presidential year, so there'll be fewer childless cat ladies voting in the election in 2026. - Yeah, you're-- - To use JD Vance's memorable phrase, right? - Yeah, it might be a good strategy and I'm no political genius when it comes to Massachusetts law strategy and legal strategy or political strategy, but yeah, you never know, and it might be hard, we're hard pressed to get that anyway, so that might be the default but-- - Justin, from Boyle's body works in Arlington, he worked with us on the illegal alien petition, he can get thousands of signatures and he'll help us, he says he'll absolutely help with rounding up signatures. I think it'll be easy to get to recruit people, but it's a question of when you wanna do it and how soon you can move. - Yeah, so the status and timeframe on this, the way it looks right now is this week, the first 10 signatures, I'm hoping to be one of them, will get before the secretary of the Commonwealth and apply for this referendum, this recall of this bill and so it takes 10, we gotta do that this week, that's our goal, it'll probably be a little bit later 'cause believe it or not, I gotta go down to the town clerk's office and I have to get that I am a registered voter and then it has to be witnessed and acknowledged by three members of the election commission or board or whatever the heck we have in our local town. - You've run for office in the town. - I know, so I gotta get one of the biggest businesses in the town, so yeah, I gotta get three signatures signing off that yes, I am registered to vote and then once us 10 have that, then we go present to the secretary of the Commonwealth where they acknowledge it and receive it and then the state has 14 days to issue the ballot question, basically what it is and guess who gets to write that, how you're not gonna believe this, the attorney general, so I'm sure Andrea Campbell's gonna write-- - She comes, and I'm not being a bad person for saying this, it's all in my book, "Hitman", her family knows a lot about firearms. (laughing) - Well, just look up the Campbell in the index to the hitman. (laughing) - Well if you, can you imagine the way they're gonna draft this, if you vote for this law, you're gonna save children, you're gonna clean up the streets, crime will disappear-- - Only illegal aliens will be allowed to own these firearms, these dangerous weapons of mass destruction. - And I'm sure rainbows and unicorns will start to appear again on our streets. And, but if you vote no, you want children to die. You know, that's the way it's gonna be. - Okay, we're gonna take a lot of, we're gonna take a lot of phone calls here. By the way, is there anything changed with the red flag law, says 9/7/8? - Yeah, there's all kinds of stuff. And on the other side, I wanna point out one of the most egregious parts of this bill that they don't even know that they did. It's really amazing. - Okay, we're gonna take lots of calls when we come back 844-542-42. I'm Howie Carr. (upbeat music) (upbeat music) - Live from the Matthews Brothers Studios. - 844-542-42. So this is a, yet another draconian gun grab from the one party, Democrat state of Massachusetts. And there are steps being taken to for style. It's immediate implementation on August 1st, which I believe is what, Thursday? - Yes. - So tell us about, tell us about one thing they did that they didn't even know that they did. - I'm shocking that people in Beacon Hill didn't know what the hell they were doing. - Yeah, so maybe if they did know what they're doing, I give them way more credit than they're very tactile. Tactical, I would say. But anyway, they redefined what a firearm is. The firearm used to be just a pistol, a short barreled rifle, a short barreled shotgun. And rifles and shotguns were not considered firearms because the barrel was longer than 16 in the case of a rifle in a shotgun, it was 18 inches. And so they redefined firearm to include rifles and shotguns. Well, I don't know if you remember how, but we have this thing called an approved firearms roster. If you wanna buy a firearm, it has to be subject to a roster that they basically, again, tell you what guns you can buy and what guns you can't buy and based off. - Who is they in this case? - In this case, it's the gun control advisory board. - Which is gonna be scrapped. - Which is gonna be scrapped, but they oversee this. And if a manufacturer wants to be able to sell a firearm in this state, they have to send it to an independent testing lab with five copies of the gun, five models and pay like $10,000 and they do all these tests to the gun. They drop 'em, they burn 'em, they do a torture test as far as firing them. And this test was designed for pistols. It was not designed for shotguns and rifles. And there's not a single shotgun or rifle on the approved firearms roster because they weren't firearms. So now all of a sudden, they are firearms and that makes them subject to the approved firearms roster. So this really goes into effect. I think it's 90 days or 180 days from when more assigned to last week. So as soon as that day comes, if we don't have this ballot then going correctly, the recall referendum, then that means there's not a single rifle or shotgun, whether it's bolt action, pump action, lever action, if it's not even an assault weapon. - How 'bout a musket? - A musket, yeah. Oh, they changed the definition of that too. - What? - Yeah, I kid you not. Antique firearms, which are like muskets and everything else, if they're capable of accepting modern ammunition or modern components like a shotgun primer, like 99% of all the new muzzle loaders that people hunt with, primitive firearms, that is now gonna be considered a firearm because it can take a primer even though it still loads down the muzzle like the old Kentucky long rifle. But they've changed that too. So this is crazy. So when this law goes into effect, I'll only be able to sell certain models of handguns that are on the approved firearms roster. - So this is gonna do a number on your business on top of everything else? - Yeah, there's no way a business could sustain itself in Massachusetts should this law be able to stand. And that was definitely by design. They wanted to cut us off at the knees. They wanna take away any possible of business being able to be sustainable in this state. And you know, they can't beat 'em, join 'em. Like they'll just figure out a way to cut 'em off at, you know, at the top, at the dealer level. - So you won't be able to get Newport cigarettes or a gun in Massachusetts, but you can get all the damn weight you want. - Yeah, and guess what this bill doesn't do a thing about? The criminal element, howie. Criminals aren't subject to these rosters 'cause they don't follow the law to begin with. And you know, we were talking earlier and whenever the mass state police puts a big Facebook post or a press release out of some big drug buster or gun bust, guess what? Is in the pictures. All these guns that none of which came from a Massachusetts gun store because they're not on the mass approved firearms roster, they're just, they're being trafficked across state lines every which way to Sunday. And they don't care because they don't follow the law to begin with. But this law does nothing to keep anybody safer, to clean up our streets. All it does is level a gun of government violence at lawful, peaceful people. That's it. - It makes criminals out of people who are law-abiding citizens. - Right, absolutely true. - And it forces you to obtain your firearms through crimes even though it puts a law-abiding citizen who pays taxes and tries to follow the rules on the same level as an illegal alien fentanyl dealer. - Yeah, unfortunately, those ones probably will get a slap on the wrist should they violate these laws. But boy, would they love someone like me or you? - C-W-O-F, C-W-O-F is what the illegal alien will get. - Yeah, right. They'll get-- - Continued without a finding. - Yeah, so this law really goes to the point where it strikes at the root. It flips the bird at the Supreme Court. It really thumbs its nose at every legal precedent that has ever been set in this country, not to mention the constitution. I mean, this is just so patently unconstitutional on its face and they don't care. They just vote it through anyway and they have the right to do it, which they don't. Oh, by the way, a lot of people are skeptical of this ballot initiative or this recall campaign 'cause it puts it out to the voters, right? So just like the legislature doesn't have the constitutional authority to vote away your rights, neither did the people. That's something that's very interesting. We have the right to, on election day, vote it back and claw this back, but we don't have the right to vote away our rights 'cause it was tried in Oregon ballot one initiative, 114, where they put it out to the people. They actually voted for an assault weapons ban and a mad capacity ban just like this one. It was almost a carbon copy of this and they voted for it. It got passed, it got signed into law and then the courts overturned it how he's saying it's unconstitutional. You can't vote away your rights, it's a right. - Right, you can't vote away a federal right in a state ballot, just like you can't vote away a state law on a local level, right? Same thing, same principle, I guess. - So, okay, so let's just take some calls here and how soon are we gonna find out about where to get signatures or how fast this is gonna move? You guys have a website set up so that people can learn about this. It's very complicated, it's gotta be boiled down so that people can understand it. - Gold.org, gun owners actually is spearheading this campaign and I will be a large part of that as well. I'll be doing live videos and video updates on our YouTube channel at Cape Gun Works and but go to goal.org and they have all the Q and A, they frequently ask questions who voted for this, who voted against it. They have pretty much some of the best summaries of the law and everything else and they will really start to get the word out. I expect nothing's gonna really happen 'cause the state has two weeks to act on it once we get our stuff in and we can't even, we would have submitted today if we could but guess what, more is having a big press conference this week with mom's demand action and all the red shirts and red coats and so she can't wait to do that. This bill hasn't even been assigned an act name so it's gotta be called something, right? So we can't even submit the petition until we have, we know it's called. - How about FTA? F2A, F2A, how about that? - That's exactly what it should be called but so once we get that act name then we'll petition with the 10 signatures and then they got two weeks to craft the language of what is gonna be on the ballot and then they'll release the petitions and so we'll get those and we will get them out everywhere. - So even though this could be stopped down the road, there's gonna be a period after August 1st when all these draconian regulations and restrictions are gonna be in effect, is that correct or not? - Yeah, I think we're gonna have to live with these starting Thursday for at least two or three weeks but then hopefully once this stay goes into place and it stops this as a referendum, then we'll at least have till election day. If the people don't do the right thing and they vote for this awful law which they very well could, I hope they don't, I hope we get this right and we don't surrender our rights, then if they overturn it, great, we're back to the status quo of what we've had for the last few years and now we can focus our efforts on claring back our rights from where it stands now. If we fail on ballot day, then it goes into effect on November 5th and it'll be 90 days from now, it'll be the implementation date for most of this law but the August 1st, it won't be the date anymore, it'll be probably November 5th 'cause they can't retroactively do it. So that's the way I understand it now and so we've got a lot of work to do, we've got to get a lot of signatures, I know we can get there. - Yeah, let us know, we'll definitely be involved in like I said, guys like Justin at the Boils Body Works in Arlington will be involved and I'm sure a lot of the people that were involved in the earlier drives will be involved. This is really a personal issue for a lot of us, this is terrible, terrible. - All right, let's take some calls here for Toby Leary. Clint, you're next with highway car, go ahead Clint. - Hi Toby, yeah, you're kind of confusing me a little bit with dates but on your website, if I order and purchase something today, do I have to physically take possession of that by the first or what's the deal with that? - No, if it's in my inventory prior to August 1st, then you're good to go. And this is just planning on like not the ballot referendum that I've been talking about, this is just with the implementation of this law. So as long as I have it in my inventory prior to, you know, Thursday, I can sell it. So if it's available on my website, you can pull the trigger on it. If we do have a pretty good batch of guns coming in every day and they're not all spoken for. So it's a fluid situation. I wish I could get more information out about what's available but if you see it available on my website, you can pull the trigger on it. And then, or call the shop or come down 'cause then you'll see what's coming out of the back room. But basically it's coming out of the back room. It's not even hitting the shelves. There's people in line, I'll take it. I'll take it. It's really not crazy. Yeah, it's crazy. - Business is gonna slow down more than somewhat though, isn't it? - On Thursday, yeah. - On Thursday, yeah. All right, good luck, Clint. TJ, you're next with highway car. Go ahead, TJ. - Hi, how's everybody going? - Good. - Considering. What is gonna happen with the license to carry renewals? Is there a hefty, a price, do you go most schooling or how does that work out? - Yeah, if you have the license to carry now, you should be able to renew it based on the status quo. But going forward, anyone who's applying, it's, I mean, I don't even know when they're gonna start to implement that, but there's all new training requirements. The state police, how is gonna be in charge of-- - Oh, wonderful. - Issuing the whole new curriculum. - Do they have to, do they get to search your cell phone for nudes? - I hope not, but there's nothing exciting on my phone. Let's put it that way. - Mine either. - A lot of dog pictures, but anyway, so they have to come up with the curriculum, the training requirements, the fees, I mean, it's madness. And to be honest with you, they don't even have the staff. It's an unfunded mandate that got passed. So there's no money for any of this. It's millions and millions of dollars between websites that need to be created, curriculums that need to be written, portals that need to be accessed, not to mention, they wanna put-- - The first thing is to get the, we gotta get the information out to people. So again, it's go to gold.org. That's where to go to. You should go there and just study up on this. And we'll try to get you more information. And so, Thursday, it's just gonna be basically a total shutdown of everything, isn't it? - Well, again, if I have it in my inventory, I'm gonna continue to sell after that date. So there's people that have placed orders that we're certainly not gonna be able to fulfill before then because of the bottleneck of just getting into the shop and getting the paperwork done. So I'm happy to transfer stuff after that based on what I can tell from the law. It says as long as it was owned by the FFL or by an individual prior to this date, we'll be able to sell it. So we're gonna continue to do sales until literally the shelves are bare. So, which could be soon at the rate things are going, but and we'll continue to replenish as we can up until the date. - We'll take a few more calls if we can and let Toby give out all the numbers and websites again before we wrap up. And also an even more important point, the reason you need to get like 70, if we need 50,000 signatures, we need to get 75,000 'cause I've been told that if one person that signs the whole sheet with 20 or 30 signatures on it, isn't registered, they throw the whole sheet out. - Not sure about that. But it could be all kinds, if there's a bad mark somewhere, they can get it thrown out. And you know that the anti-second amendment people will be perusing these things with fine tooth comb. So they gotta be clean signatures on it. So again, Toby, very, very quickly, just give us like a 30-second rundown of what this bill does for people who tuned in late and where they can go to find out more about this abomination. - Yeah, so they can go to goal.org. But so again, the long guns are now added to the approved firearms roster and subject to the approved firearms roster. That's a big one. Expansion of the definition of assault weapons banning most semiautomatic rifles and shotguns. It's just unbelievable. Banning threaded muzzles on handguns. So even all the handguns that are currently on the approved roster, not all of them will be able to be sold. There's gonna be a conflict between the roster and the law as it goes through. And there's all new sensitive location restrictions that any state, county, and municipal government property where you can't carry. There's a ban on transfer of semiautomatic guns by FID holders. And this is where the seizure type of thing happens. So there's a lot of people that are 18 to 20 year olds that currently own a semiautomatic rifle or shotgun. And how he, as when this bill goes into full effect in 90 or 180 days, whatever it is, they are in limbo. There's no language in the bill that says what they have to do only that they can't possess what they currently own. So that's a fifth of that. So you can join the military and go through basic training and learn how to have a heavy duty firearm, but you can't own, you're not gonna be able to own a shotgun. - You can't own your semiautto shotgun, your Benelli Super Black Eagle that you go duck hunting with. It's insanity, a three round shotgun to go duck hunting. You won't be able to own it and possess it. - How about World War II inherited handguns? - Yeah, you'd be fine with stuff like that, but a lot of, it's a big mess. - Okay, you'll be on with Grace tomorrow at around two o'clock on The Grace Curly Show at around two o'clock on WRK on all the other stations.
