BREAKING: Arizona State Land Department Cancels Coyotes Land Auction

With just under a week to go until June 27, the Arizona State Land Department has cancelled the Coyotes land auction. ASLD recently confirmed that the proposed arena use will require a Special Use Permit and as a result, are requesting that Alex Meruelo receive it prior to the auction. What does this mean for the timeline? Will Meruelo still go through with everything in an effort to bring the Coyotes back to Arizona? Craig and Leah discuss on this emergency edition of the PHNX Hockey Podcast!

Do we already do this today, Craig? What is happening? Oivee. This is such classic. This is so classic. Oh my goodness. Thank you all so much for tuning in to an emergency edition of the P-E-Tronix Hockey Show. I'm Leo here with Craig, and this time we're in the Four Peaks minibar because we need a beer after what transpired today for what might have been the shortest shelf life of any story show combo in the history of P-E-Tronix after we spent 30 minutes this morning saying everything you needed to know before the June 27th land auction next Thursday, the Arizona State Land Department said, "You know what? It's canceled, and here we are now, Craig. What do you know?" What do we know? We know that I'm just going to say it, that the coyotes that Alex Morello's ownership group somehow screwed up this process as well. We were told a long time ago that this land was already zoned for an arena, and silly me, I made the assumption that, you know, they probably checked into this before they embark on a multi-billion dollar project. They probably have made sure that it's actually zoned for an arena, but I checked last month with the city of Phoenix, and they're like, "Mm-hmm, necessarily of this scale." The Legacy Sports Project that was in place in another location of the North Valley had the same sort of zoning designation, right? So the assumption was, "Well, that's an arena. This is an arena. Sure, we can build a 16 to 17,000-seat arena versus whatever, a 3,500-seat youth arena that's much lower, much smaller in scale, period." City of Phoenix said not necessarily that that's probably open to interpretation. How the coyotes did not do that due diligence before they embarked on this project is just it's mind-boggling. I want to read something from an AZ Central story because I've been following Taylor Seeley's reporting on this, and they spoke to... I'm blown away by this. I'm blown away by this, okay? They spoke to the council member, Jim Waring, whose district this arena was sit in, and he said, "The coyotes need to get a zoning attorney. They don't have one." Just let that sink in for a moment. Just let that fact sink in for a moment. You're embarking on a project of this scale, and you didn't bother to get a zoning attorney to make sure that you could do what you said you were going to do. That is just gross incompetence. That's what it is. Gross incompetence. How did you not check that box before you went ahead? And it's just another in a long line of colossal mistakes that this ownership group has made. We know they got... They exited Glendale unceremoniously, and again, as I said at the show this morning, just a few hours ago, that wasn't all on them. There was a lot of bad history with Glendale, but they did. They did mis-manage those negotiations. They lost the Tampi vote, which they were telling everyone they're going to win in resounding fashion. They lost the friggin' team. They tried to move the Tucson Roadrunners to Phoenix, but didn't check with the stakeholders ahead of time, and in fact, no, they're not moving to Phoenix. They're only playing six games up here, which was one more than the original contract allowed. And now we find out that they didn't even do the due diligence required to make sure that they could actually build an arena on the plot of land that they're seeking to buy at land auction and spend... Who knows what the final cost would be? I know what I put out there, but they're never what they are. But this is a multi-billion dollar project. Make sure you have all your eyes dotted and tees crossed before you go ahead with this. And again, they didn't do it. It was always going to be zoning. Am I shouting? I'm shouting. It was always going to be zoning. We should have known, we should have known when we joked about this being a zoning podcast, that it was going to come down to zoning. So for those who maybe are just tuning in, or you're just getting off work and trying to catch up with what's going on, basically the land auction schedule for next Thursday got canceled. And the reason being, and you can find this statement on Craig's Twitter account @Craigasmorgan. In the official statement, they said, "After much consideration, the Arizona State Land Department has determined that it is in the best interest of the trust to cancel the auction and reorder the steps." ASLD recently confirmed that the proposed arena will require a special use permit. And as a result, we're requesting that the applicant file for and receive a special use permit prior to the auction. Sorry, I'm responding to that. You can imagine, I'm getting a lot of communication. So basically, it all comes down to the zoning. It all comes down to the use. Taylor Sealy just told me that the Republic's reporting is that the State Land Department reached out to the city of Phoenix for a clarification, found out it does in fact need to be rezoned. So just what we're saying here, it's already clear they need a special permit, so they need to rezone it. People have been wondering why the Land Department did not tell the coyotes this sooner, because they didn't know. They didn't know. I reported it, I think, a month ago that it might be, but it wasn't definitive from the city of Phoenix. But again, you've got the coyotes saying they already did there. They already figured this out. They want to buy the land, and they'd already know that they can build an arena. It's not necessarily the State Land Department's job to worry about what's going on the land. They're selling the land, okay? For development, then it falls under Phoenix's jurisdiction to decide what can be built on that land. Again, this is incumbent on the coyotes, not the State Land Department. They should have known all of this before they even barked on the project. And again, they did it. They just showed gross incompetence once again. And can we just say it, Leah? Just go away. Go away. Your response to this is you're going to threat, veiled threat of legal action. We're pursuing all of our legal options. Well, here's, here's the first one that Jim Waring just told you you should have pursued. Hire a damn attorney who knows something about zoning. That's what you should have done first, and you might not have been in this position in the first place. But secondly, you're going to threaten legal action against one of the stakeholders that you need to build bridges with. Another example of just being utterly clueless in the process of getting this done. You need to build bridges, not piss people off, not threaten people, not put them on blast on social media when we're talking about the mayor of Phoenix. Get a clue, Morello ownership group. Get a clue. Everything you are doing is wrong. And people still think that this is the fastest path forward. There's still people out there delusional enough to think that the Morello group is still the fastest path forward. Is it not crystal clear to all you people in denial that nobody wants to work with this guy? Nobody wants to work with this guy. He is not the fastest path forward. He is an utter disaster every step of the way. Just go away already and let somebody else have a crack at it. Wow. Well, I don't know how to follow that up, but I guess we can look at the statement that the coyotes just put out about an hour ago. So let's take a look. It said today, after over a year of planning and meeting every obligation required under Arizona law, the Arizona State Land Department unilaterally canceled the auction that was scheduled to occur on June 27th for the site that has been identified as the future home of the Arizona coyotes. This unprecedented action by the state of Arizona seriously jeopardizes the future of NHL hockey returning to the desert. So we can pause. Do you know what jeopardizes the future of hockey in Arizona? Being named Morello? Yes. Yes. Okay. Continuing on, as was announced in the April press conference by coyotes owner Alex Morello and NHL Commissioner Graham Emmett, which we remember very fondly, that press conference, the site of North Scottsdale Road in the 101 was identified as ideally suited to build a 110 acre mixed use development anchored by a state of the art arena to serve as the home of the coyotes. It has been made very clear to the state of the state of Arizona that the coyotes are fully committed to building out the infrastructure, going through the necessary approvals and developing the site into a world-class destination that the ASLD has canceled the auction despite the objections of the coyotes less than a week before the scheduled auction date. I don't really understand that you can object to something that is like legal, but we'll move on to part two, which says the organization has worked in good faith with ASLD and has been on the track to win the auction next week until the sudden reversal by ASLD today. By canceling the land auction, the state is for going millions and potentially billions of dollars that would have gone directly to K-12 education. By investing in the infrastructure of this site, the coyotes would have unlocked over 2,000 acres of state land for development that would have returned over $2 billion to Arizona schools, created thousands of construction and permanent jobs, and created a new significant tax base to support the future growth of our state. The Arizona Coyotes are exploring all of our legal options given to this short-sighted decision by the state. You know, all that might have been true. They might have been able to give a lot of money through to education. And listen, I know there are a lot of arguments about what arena districts funding and arenas actually produces for a city. There's disagreement there. I have my own views that I'm not going to get into again, but if you wanted to make sure that that money went to K-12 education, which I'd really like to see in a state like Arizona that spends far too little on education anyway, you know what you should have done? You should have hired a zoning attorney. You should have started with the zoning attorney. You should have found out that you could actually build on this location. Do I keep coming back to this point? This is a revelation to me that they then didn't actually go through this legal process. This is the most important piece of this story in my opinion, because a lot of this other stuff we knew already, and they're also quoting Scottsdale Mayor David Ortega, who in my opinion is just an attention whore, who has no place in this story whatsoever. It wasn't in Scottsdale, so please, Mayor, just shut up already, because you have no part in this story. I don't even know why you're being quoted. But how did you not take care of this very basic step? We have been told again and again that Alex Morello is a very successful businessman. He rebuilt a pizza chain. He's got casinos. He's got media interests. How does a business get run like this and be successful? What's happening in this particular branch of the Morello Empire that led to so many mistakes, so many critical mistakes along the way? It is dumb-founding that we are just adding. We keep adding chapters to this crazy story, and again, I'm just going to say it. Just go away. Take your money and go away. Is it not apparent to you that nobody wants to work with you anymore? Well, yeah, I think that's been clear, and that statement is just, and what I said in our Discord, like about 30 minutes ago, I said, why won't you just say? We're disappointed by the cancellation of the auction. We were really looking forward to winning the land on June 27th. However, we are still committed to pursuing the land. We want to bring the NHL back to Arizona, so we will do everything we can in accordance with the Arizona State Land Department to make this happen. That should have been the statement. That statement read Petulant. It read defensive. It read victim, and that's everything about this. It was a threat. It was, again, to stakeholders that you need. You're threatening them. But it's the same exact thing that we saw at the press conference where we asked about season ticket refunds, and Alex Morales was giving us a second to breathe. How about no? You're the one who lost the team for this fan base, for all the people who just lost their jobs last week. How about you cater to those people instead of thinking about yourself for one second? That statement, if they could have just waited one extra hour to take a deep breath. And listen, I'm sure they were caught off guard. I'm sure they were upset. I'm sure they were blindsided. And by the way, yeah, it's like a Friday news drop, right? There's nothing they can do about us so late in the day. They have, they have every right to be extremely frustrated. I couldn't imagine, like, after, I mean, April the 6th was when we found out that the date of the auction, and I can't, or sorry, it was April 4th, I think. And I can't imagine after, like, two and a half months of anticipation just a week before getting ripped out from under you. I totally understand the frustration, but that's behind closed doors when you're putting out a public statement. Just put your head up high and say, we're disappointed, but we want it. We are committed to bringing the NHL to Arizona, and we will do whatever it takes. We believe that this is the spot, and they said, you know, we think this is the spot. Sure. You can say that. But I don't understand. It would have given billions to the state. That's their loss. Okay. They literally said it requires a special permit. Go get the permit. Yeah, you can still do it. Or the Arizona State Land Department could sell it to somebody else. They could put it up again and say, hey, we'll find out if there's another buyer, and then the money could go to education from someone else. But I had like four PR people reach out to me to say, to say, wow, that statement was just an utter disaster. Yeah, it was. It just proves again that the coyotes have no clue about messaging. I have to say, though, a few thoughts that I had this afternoon. First of all, could you imagine if the team was still here? And June 27 was the penultimate date, and then this happened with the team still there? What we would all think the league saw this coming. Somebody in the league saw this coming real, real overtures from the league that they saw more problems coming, more obstacles coming. They were right. They knew. And listen, that tells you, look, I know that there's this national narrative out there that, oh, Salt Lakes, it's great. It's a home run from the start. No, it's not. It's going to be really rough for a year plus in Salt Lake City because, and that's not Salt Lake City's fault. It's not Ryan Smith's fault. He wasn't ready for this. He wanted an expansion franchise. I know I said this earlier, but he wanted an expansion team. He wasn't ready to pull the trigger on this right now, but the NHL asked him to do it, to do them a solid, to extricate themselves from this horrible situation they were in in Arizona with the Morelos. So Ryan Smith did it. He's going to suffer for a year. The franchise is probably going to suffer for a year at least while they try and get some of these things sorted out. But that was still a better option than staying under Alex Morelos stewardship. Yeah, it's extremely telling. And by the way, Craig, as you tweeted earlier today, there was no mention of whether they still intend to pursue the land and there's no further statements expected today. Nope, we're just angry. We're going to lay on our backs and kick our feet and threaten legal because that's all we got a lot of people. I've some people have reached out to me saying, you know, this to me seems like they're giving up, which this statement seems like they're not. But somebody's theory was what if you know, they're this is their way of walking away and they'll believe and cover though and they'll blame it on the state. But does anybody going to buy it? You could say that. You can say those words, but nobody's going to buy it, especially when they know the mistakes that you made. It's not like it's perfect cover for the Morelos to walk away. We all see the truth here. We all see where the mistakes were made. So if you're going to try and use this as cover, people just couldn't be like, yeah, whatever. But but on the other hand, by all means, go ahead, walk out the door. So let's just say they say, okay, you know what, we're going to go get the special permit. We're going to do this process again. The 10 week posting all that still applies, right? Yeah. But are you even assuming that they're going to get the special use permit from the city of Phoenix? Do you think Caio go and the city council, including Jim Wary, who was just quoted, are going to support them? I don't know. I don't. Yeah. So how do they go about getting the special permit? Dude, I do not know the. If you are a call person and reporter, please tell us how you get a special use permit. We don't have to research that Cat Coleman, we need you. We just got to do we just got a dude from Craig. That's how badly the coyote is so fucked up. Oh my god. By the way, the chat is on fire right now. We appreciate you all venting here with us. Throw us a like while you're here. And make sure you're subscribed to the page and exports you to channels. You don't miss in case we have to have an emergency podcast for the cancellation of an auction. We just spent the whole morning talking about Craig. Craig wrote an article. We did a whole show. It's fine. It's fine. I can't help wondering. I know a lot of people are like, he's got to walk away now, right? A lot of people are texting me. He's got to walk away now, right? Like and literally lots of people in hockey circles are rooting for Alex Morello to walk away. I think most people in hockey circles are rooting for Alex Morello to walk away. Do I think he's going to do it? I'm not so sure. As Bill Daily told us, he's got that basically a three and a half year window, right? Where he's got to have the land, he's got to have the arena 50% built. So really, it's like Bill said, it's more like a, it's more like a three year window because if he hasn't started the arena within three years, it's not happening. But he's got the rights for now. That's what it says in the legal agreement. So does he have to walk away? I could, I could absolutely see Alex Morello delaying this as long as possible, even if he's not going to be able to get this done himself. I could see him sticking it to the city, sticking it to the fans and not stepping away. I don't care about the people who just just lip service. I know, but okay, there just needs to be an owner who does because I can't take it. How are we? How are we this upset? And there's not even a teeny. It's like good war. You're trying this. You're like, okay. I'll come back to the trough again. I'll think that maybe you learn some things. Maybe you'll get some things right after making all those mistakes in the past. Maybe you're at least going to give it a good college try, the old college try here. Then you find out he's made another colossal mistake by not making sure that the zoning was locked in before moving head with the deal. The only good thing to come out about this is the wonderful t-shirt that Lee is wearing that you can get. That is true. Deactivated fan. We're all one of them. We'll start with Roaring Fork, who sent us $10 and said this is for Craig's donuts and the cost of an interior vacuum on Lee's car. Appreciate it. That is a nod to The Smorning Show, which is now almost irrelevant. However, we did talk about nicknames and we previewed tonight's game. So not entirely out of date, just yet. Go back and watch. Yeah, there's a game tonight. There is a game. It starts in 40 minutes, actually. John sent us a super chat, added $10. I'll add to Roaring Fork's fun for Lee's car. Appreciate you both. You can chip in for the CircleK gas fund, and then Shelby sent a super chat, Craig, buy yourself a beer after this, please. If only these taps really just meant spear, we would be doing this live on the show. These taps could speak. Oh my God, he's in the chat saying go away. Talking about Morello. So I think he's talking to Craig. No, I mean, that looks too. Oh my gosh. I guess all I will tell you. For better or for worse, and I'm really happy that somebody else is reporting on this story, like in depth. I think you should read, you should pay attention to Taylor Sealy's reporting over at AZ Central. She's doing a really good job. It's nice to have someone else. People ask me often, do you like being the only guy reporting on the guy who's? No, it sucks. Craig's supposed to be the Cardinal's beat writer now. Yeah, that there's that too. But I will continue to follow this story. You have my promise. I gave you a land auction primer. That was good for four hours. Got a whole four hours. But I will continue to follow this process till it plays out. I'll continue to report on potential groups that may arise if, in fact, Alex Morello does the decent thing and bows out. Finally, I will continue to report on hockey. As you all know, it's a passion of mine. It's a love of mine. Not this side of it necessarily, but I have a lot of years invested in this. And I have a lot of people that will talk to me. So I'll continue to report on hockey in addition to my other duties. So there will be more news on the coyotes slash arena front. Because it feels like they're always will be until forever. I can't escape it. Just like Alex Morello owns the rights until he does it. There doesn't. There will always be coyotes arena drama until there's not you know what I'm picturing. You guys, you know what I'm picturing picture me at like like the age of like 88, 89, maybe even 90 if I make it to 90. I'm in my bed. My family's gathered around me. My breath is getting shower less less less air coming from me. And just as it looks like I'm going to not off and finally, you know, move on to whatever's next. My phone buzzes and it's coyotes arena news and I've got to come back to and tweet something. No, I thought it was going to let's make it more peaceful. You and your wife have retired to Western Europe. You're sitting on the beach in Italy with a glass of wine in your hand. And you're feeling, you know, you're getting a little weaker. It's your final days. You're very old. You're in a wheelchair. And I show up feeling Godfather now, isn't it? I show up. I show up. I show up. I show up. I'm like, I'm older. And I say, Craig, it's all over. They finally have an arena. It's all over. And you say, Okay, and then I expire. Okay, so it still ends with me dying. No, no, no, well, that Craig told me he didn't die in it. I did. I really survived temporary. That's true. I revived temporarily. This is made of my family around me. I wasn't in a courtyard by myself in Italy. No, it's over. They've got an arena. Look at the rabbit. We completely lost it. This whole thing has made us delusional. Good lord. Oh my god. Petey brought up a good point in the chat. And he said, you know, I wonder if Alex Marlow sees himself as the savior and not the one who lost hockey. He must. I suppose in some alternate universe, you've viewed yourself that way. I have no idea at this. Look at the look at the bullet points that I just laid out aside from a lot of other things, right? You got you lost the arena that you were in initially. You lost the vote in Tempe. You lost the team. You lost your efforts to try and get the Tucson rotors up here. You lost an auction. You pissed off most of your staff. Most of your employees. You didn't leave the auction. You lost the auction. That's the truth. Heard from a lot of them. How are you a savior? What are you the savior of? You know, your best chance at still preserving a little bit of that identity is to walk away. He might be. That's the biggest favor you could do the hockey community here in Arizona at this point, because this is an utter disaster. Yeah. Yeah. It's going back to dead Craig for a second. Craig, if you do. Kenny Kenny has a great point. You should come back to haunt the new arena. Yes. I like that idea. I love that. Oh my gosh. They say that the ghost of Craig Moore haunts this press box. Well, we'll bury you under the site. They could be like a polter guy situation where it's your barrier. Reporters have known to be riding on deadline. Suddenly, they hear a voice over their shoulder. That's not a big style. Caleb says Craig's late to rest hours later. Arena news breaks. Craig pulls an undertaker. He's back. Oh my god. I can't even. Yeah. All right. We'll let you go until our next emergency podcast. Kind of large. Anyway, a couple more super chats before we wrap up here. Appreciate you all. We'll start with Johnny Venerable. Wow. Johnny post a peach next car. It was live in four minutes. Can I read it in Johnny's voice? Sure. Johnny gives five dollars and says, Craig, how dare you break more Coyote's news? Cards called Dibs on Mr. Morgan Leon. Sorry, buddy. I'm sorry. Johnny, take it off with more. I really am. Wild Lee Coyote said Craig could do a better job on winning the land auction than Morello. I'm sure you would do your due diligence, Craig. No, not Morello. More Jello. More Jello. Yeah. Blainley asked and I said, can you confirm that Javier Gutierrez was fired so he can open his new business that will offer a visit to the Titanic via many subs? Let's not forget the profound incompetence he has shown since 2019. He has not been fired. Yeah. I don't know how involved he is. I mean, the whole point was he was going to listen to the auction and now the auction's canceled. So yeah. Yeah. I don't know how much more will see or hear from Javier. My understanding all along really was that he was a bridge to get the kids up and running where they could run the franchise. You have thoughts on that as well. But I don't know if he's going to stick with this through this process or not. Honestly, I just don't expect to hear from him much anymore. Kimberly sent a moving sticker that's a girl going like this saying hype, but what does it say on e-cam? These are my favorite. Can't really thank you so much. It says hippo character with stars growing in eyes pumping his arms up to guy. Oh, all right. With the word hype pulsing above. That's exactly what it looks like. So appreciate your super chat. I appreciate everybody in the chat chiming in. A lot of people kind of throwing in the towel giving up that it's ever going to happen for the coyotes to come back. I say as long as Gary Bettman is the commissioner. Don't give up yet. I mean, it's fatalistic. Listen, I understand the skepticism, especially when you look at the history of this franchise. It's not sparkling. I get it. And I, as I've told you, I know that there are other groups interested. I have spoken to these groups, but we won't know how serious they are until they're allowed to pursue the process. That's what we'll know if there's another real possibility of NHL hockey coming back. But as I've said all along, I always thought the five year window was a pipe dream. I never thought it would return that quickly. So we may have to wait a good chunk of time. And my guess is, you know, I may be on that. I don't think it'll be late coma. What's a much lower brow lake in Italy, maybe somewhere in the South. You'll be in Salt Lake. Oh, no. No, I won't. Don't go there. Don't go there. Oh my goodness. Yeah, keep the faith. And I think this just goes to show. I think we would at least you two and I'm going to speak for you. You can let me know if I'm wrong, but rather wait a little bit extra and have the right situation happen than the fastest one and have it not be right. Yeah, because it just like if this is the ownership group, what faith you have that things are going to be done well based on the track record. Why would you believe? Yes, he hired Bill Armstrong. He made he made a good hire there. Javier made a good hire there. You know, the lead gave some names and he whittled it down and they chose Bill Armstrong. That was a good hire. Bill hired all the other hockey ops people. Okay, so they got Bill Armstrong right and I'll hand it to them. But I again, news travels fast and actually I didn't even have to travel fast because they've seen what's been happening here for the last few years. People in hockey circles know what it's like to work for the Morelos. So if you think they're getting the best and the brightest the next time around, think again, yes, they'll get someone because they're only 32 jobs, but it's not going to necessarily be one of the top candidates anymore. Because again, people hear people talk, they know what it's like to work for this ownership group. Yeah, there you have it. Someone on Twitter just said the shirt we should add deactivated fan on the front deactivated land on the back. Just add to the saga. You know, I should go at some point, I should get a map and just put pins in all the potential arena sites that we found over here because it's crazy, right? Yeah, it could be. Oh my goodness. All right. Any final thoughts before we get out of here? No, I'm tapped out. I'm exhausted. Tapped out? Hey, we'll plug there. Okay, well, we appreciate you all so much. I'm just moving on. Appreciate you all so much for being here.
