And these changes will affect how you buy in sell homes here in California and actually across the United States. And if you haven't heard about these changes yet, don't worry. We've got you covered here at the Radio Realtors. This segment is called "Navigating the New Normal in California Real Estate." And today we're going to be exploring how the recent settlement between the National Association of Realtors or NAR is reshaping the real estate landscape. So let's get started with some background on this. And I'm going to try not to make this a boring show for you today. But back in March of this year, 2024, the National Association of Realtors, they agreed to settlement terms that are set to modify the home buying and selling practices for consumers across the country, including right here in the Golden State, right? And these changes officially go into effect today. And they're going to alter the way real estate agents get paid for their services, as well as how buyers interact with us agents. Now, I know what you're thinking, change can be a bit daunting, especially when it comes to something as significant as real estate. But knowledge is power. Remember that. And by understanding what's happening, you're going to be better equipped to navigate this new landscape. So before we get into the specifics of the changes, let's kind of just take a moment to review how real estate agents, I'm a real estate agent, how we typically get paid for our services. You see, most sellers agents work on a commission-based model. And this means that their payment is a percentage of the final sales price of the home. And that payment happens at closing. And if the seller has agreed, their agent will pay a portion of that commission to the buyer's agent. Now, this commission split has been a standard practice for a long time. But starting today, and I'm talking about today, there's a new twist in the process. If you're a buyer who wishes to tour properties now, you must be represented by an agent and you will now need to sign a buyer representation agreement. And this agreement will detail the services provided by us, the realtors, as your agents and the associated fees. And traditionally, the buyer's agent fee has often been covered by the seller as part of that commission split I mentioned earlier. However, if the seller does not agree to pay the buyer's agent's fees, then as of today, you as the buyer will need to cover that cost directly as negotiated in that buyer broker agreement. And as a reminder, the commission and offers of compensation to buyers agents, they have always been negotiable terms in California's representation contracts. And the amount a seller agrees to offer a buyer's agent has been visible to other agents in the multiple listing service or what we call MLS. But that's where this first substantial change is happening, right? So the first notable change that's being implemented today is regarding offers of compensation. And according to the new NAR settlement, compensation offers will no longer be allowed on the MLS. That's right, starting today offers of compensation to buyers agents will no longer be advertised on the MLS or any MLS related aggregators. So what does that mean to you? Well, it means that while offers of compensation to buyers agents are still allowed, they will now need to be handled off MLS. And listing agents can still advertise these offers, but they're going to need to do so through individual marketing materials, like signs, flyers, websites, word of mouth, and so on. And what's going to happen here is this change is going to add a new layer of complexity to real estate transactions, especially when it comes to how agent compensation is handled. Now, I know I just threw a lot of stuff at you, but these changes, like we said, are happening today, whether we like it or not. And it is going to make things much more complex, especially for home buyers out there. Fortunately, you're listening to agents who have over 20 years of experience of dealing with negotiations, dealing with changing markets, dealing with different interest rates, dealing with different types of personalities when it comes to buying and selling. And we are expert negotiators. In fact, I think we could be hostage negotiators. We are so good at negotiation. And that's what you need in this market. So the changes are coming. We're going to come back with some more information about the implications of compensation offers moving off of MLS and some more information about concessions and those types of things. I am your real estate professor and I feel like I'm actually giving a lot of instruction today because today we are talking about navigating the new normal in California real estate. And beginning today, we have something very interesting happening. The National Association of Realtors or NAR agreed to a settlement and now that is reshaping the real estate landscape all across the United States as well as right here in the Golden State of California. And the settlement terms are set to really modify things a lot. These changes officially go into effect today and they're going to alter the way us real estate agents get paid for our services, as well as how you buyers interact with us agents. And it's very, very interesting. So we gave a little bit of an overview of how agents typically get paid. And basically most sellers agents work on a commission based model and this means that their payment is a percentage of the final sales price of the home. So we will not know exactly how much or if a seller is offering concessions to a buyer's agent. So let's break this down a little bit further. What are the real world implications of moving compensation offers off of MLS? Well, for sellers, this change means you'll need to be more proactive in how you communicate the compensation you're offering or not offering to a buyer's agent. And since these offers can no longer be advertised on MLS, we have to find alternative ways to ensure that information is conveyed to potential buyers and their agents. And this can involve, well, it will involve more direct communication, custom marketing materials or working closely with us, your listing agents to develop a strategy that works best for you. Now, for buyers, this change could potentially complicate your home search and your home buying journey altogether because without immediate visibility into what compensation, if any, us, your agents will receive from the seller, we will need to have more in-depth conversations about how we're getting paid and how that might impact your budget. And it's essential to be clear and upfront about these matters from the beginning so that you can avoid any surprises down the road. And ultimately, this change means that buyers and sellers are gonna need to be more engaged and open throughout the transaction process. And with the right approach though, the process can still be smooth and transparent. Now, let's talk about another important aspect of real estate transactions and that's concessions. Compensation isn't the only thing that buyers and sellers negotiate. Concessions have always been a part of the home buying process and they will remain so under these new rules that are going in effect today. Concessions can take many, many forms. For example, maybe a buyer might ask a seller for an allowance to replace old carpeting or help with closing costs or even credit for maybe a new roof or something. These types of concessions are still allowed under the new rules and they can be a valuable tool in making a deal work for both parties like they have for years. Now, under the new rules, compensation to pay an agent can also be handled as another type of concession in the offer to purchase depending on what the seller agrees to. And sellers have always been able to offer concessions as incentive to buyers and this will continue under the new regulations. The key difference here is that the visibility of that compensation or compensation offers to a buyer's agent for real estate services will now be prohibited on the MLS. And this means that while the process might become a bit more complex, it doesn't have to be more difficult with clear communication and the right agreements in place, both buyers and sellers can still achieve their goals. Now, let's move on to the second major change that's going into effect today and its buyer representation agreements. Now, the National Association of Realtors has long advocated for the use of these written agreements between agents and buyers, but starting today, this is no longer just a recommendation, it's a requirement. And if you're a buyer who wishes to tour a home with an agent, you're gonna now need to enter into some type of written agreement with that agent or brokerage. And this change is a big deal because while buyer representation and agreements have been used in California for some time, not everybody has been using them. However, now requiring a signed agreement before touring that first home is gonna become the new normal, right? And this applies to both in-person and virtual visits. And there are a few exceptions to this rule. Now, while the new rule requiring buyer representation agreements is comprehensive, there are a couple of exceptions that are worth noting. First, home shoppers will not need a signed written agreement when they tour an open house. If you're just dropping in to check out a property during an open house, you won't be required to sign an agreement with the hosting agent. However, if you decide to engage that agent for a private showing of that house or any other house or to help you with your home search, you're gonna need to have that signed agreement in place before you can proceed. And they say that this change is designed to create more clarity and transparency in the relationship between buyers and agents. It also formalizes the expectations on both sides and ensures that everybody is on the same page right from the start. But how is this gonna impact the home buying process? Well, let's explore that. The introduction of the mandatory buyer representation agreements is likely to have several effects on the home buying process in California. For buyers, this change means that you need to be more deliberate about choosing your real estate agent. Since you're gonna need to sign an agreement before touring homes, it's truly essential for you to do your homework and find an agent who you can trust and feel comfortable working with. And this agreement formalizes your relationship, so it's important that you choose very, very wisely. Because of these changes, who you work with, it matters more than ever before, because you could wind up paying your agent's commission along with your closing costs. However, here's the deal. And so who you work with matters, but we're going to take just a kind of a little break and give you our checklist for the new homeowner. So if you just bought a home or you're almost ready to close on a home, we're celebrating something special. And that's your new home, right? Congratulations. I mean, a lot of hard work. And you know, we know it's been a long and sometimes stressful journey once you get to that place right there. But now that you've got those keys in your hand, it's time for you to make sure that you're starting off on the right foot. And that's why we put together a handy five step checklist to help you settle in and make your new house feel like home. So grab a pen, jot down some of these tips, and I think you're going to really like them. Let's get started. Step number one on our checklist is notifying the post office and your bank. You know, and this might seem like a small step, but trust me, it is a big one. You're going to want to head over to your nearest post office or hop online to fill out a change of address form. But this will ensure all your important mail follows you to your new address. And don't forget about your bank as well. Man, this is a big one because you want to update your billing addresses for credit cards and online shopping platforms like Amazon. That's going to save you a lot of headaches down the road. I actually had a client who forgot to do this when they had moved from a car Michael to actually sit your sights and they kept their old address in their Amazon. And so they were ordering things and they're going, why is our stuff not showing up to our new house? Well, the reason was, is it was going to the old house. So they were treating the new owners of their old house to lots of great stuff from Amazon. So you want to make sure that you make those changes, especially on your banking information, all of those credit and online shopping platforms, make sure you get that done. Next step, step two, is switching your utilities and your services. And this is super important. After you've taken care of the post office and the bank, it's time to call your utility providers. When you're working with the radio realtors, we actually give you a list of those utility companies so that for your specific area, you know exactly who to call. And whether it's electricity, gas, water or internet, you need to make sure everything is up and running smoothly at your new place. I mean, the worst thing that could possibly happen to you is you buy a home, you don't get that stuff done, we give you the keys and you show up and we show up and it's the middle of October and it's dark early and it's raining and you have no electricity, no utilities in your home. It is a bad situation. So make sure that doesn't happen. And don't forget about any ongoing services like maybe pest control or lawn care or pool care or housekeeping, let them know about your move too. 'Cause you don't want to be paying for services at your old address or miss out on them at your new address, right? Now moving right along to step number three and this is another biggie, is making sure you're safe in your new home. Now, if you bought a home from a previous owner, there's a chance that they could still have some keys lying around. So it's a good idea to get a locksmith out to re-key or replace those locks. And I'm not saying that the previous owner is gonna just show up at your house and use their old key to get in, but you don't want to have old keys all about, you know, maybe use to get into your home. And you will also want to change the codes for your garage and any other entry points with like a keyless entry while you're at it. And inside the house, you want to check your smoke detectors, carbon monoxide detectors and fire extinguishers. And if you didn't do it before closing, if you're working with us, you already did, but you want to consider hiring a professional to check for any hidden issues, like maybe mold, dry rod or termites, it's just better to be safe than sorry, right? But if you're working with us as your buyers agents, I will tell you, we're gonna make sure that you get those types of inspections. Now, step number four is all about fulfilling promises to your family. You know, moving can be tough on everybody, especially if there were things your family had to give up to get into the new home. If your kids were dreaming of a pool, but maybe your new house doesn't have one, you might want to start planning for it if it's in your budget. And you want to research local companies and get quotes and create a financial plan. Involving your family though in these plans can make the new house feel more like a home and help everybody adjust more easily. Now, last but not least, step number five is review those HOA rules. If your home is in a neighborhood with a homeowners association, you want to get familiar with those rules quickly. I mean, the HOA often has guidelines on everything from what you can put in your yard, how you maintain your property, maybe the color that you paint your home, maybe can't change your oil in your driveway. And there's different rules for all the different HOA's. And some are super strict and some are a lot more lenient, but by reviewing those rules now, you're going to avoid any surprises and ensure you're in compliance from the get-go. And I remember I had a client that they just could not keep their bushes in front of their house green. They kept on going brown, but they didn't want to replace those hedges. So they bought some paint that was green and it was good for the environment. It was safe for the environment. It was a natural color paint, but they basically just spray painted their hedges in the front and then they were able to stave off the HOA for a little bit. And so there's options for you if you need to. I mean, we've even had people where they painted their front lawn and there was a natural paint that they could use and it lasts for a while. So make sure you know those rules, right? And there you have it folks, your five-step checklist for new homeowners. And it might seem like a lot, but taking these steps will make sure your move is smoother and your new house feels more like a home in no time. So make sure that you have that communication with them. And that kind of information is out there in the open right way. Now, third thing is you cannot be afraid to ask your realtor questions. You know, whether it's about the recent changes we're discussing today, the home buying process, or maybe just a realtor's approach to negotiations, a good agent should be happy to answer your questions and provide the information you need to make informed decisions. And finally, you need to trust your instincts. You should feel comfortable with your agent and confident in their abilities if something just doesn't feel right. And it's all due to the recent NAR or National Association of Realtors settlement and what was agreed to. And these changes, like we said, go into effect today. It's changing offers of compensation for buyers agents, especially, because they will not be advertising commissions or concessions percentages on MLS. So it's going to take a lot of extra negotiation and communication. And one thing for you buyers is that going into effect today also is buyer representation agreements. And the National Association of Realtors has advocated for the use of these written agreements between agents and buyers. But starting today, it's not a recommendation. It is a requirement. So if you're a buyer who wishes to tour a home with an agent, you now need to enter into some type of written agreement with that agent or brokerage. And the introduction of these buyer representation agreements is likely to have several effects on you as a home buyer. It means that you'll have to be more deliberate in choosing an agent. It means that you have to sign an agreement before touring homes. And the agreement formalizes your relationship with us. So it's important that you choose wisely. And because of these changes, who you work with matters because you could wind up paying your agents commission along the way with your own closing costs.
