It was a fabulous Northeast Washington Fair, but things are going to stay busy this week around the Callville area. Boy, get ready for another busy week. It is a Monday. Thanks for joining us on the radio. I'm Eric Carpenter, and this is KCL, KCRK. Hard to believe it's almost Labor Day, and yeah, kind of the end of summer here in Callville means it's Farm Jam time. Yeah, Farm Jam 2024 is coming up this weekend. Let's get an update on the big event from host Greg Knight. Greg Knight, Farm Jam Music Festival. Callville, Washington takes place Labor Day weekend. It starts Friday, August 30th with four bands, and then it continues on Saturday, the 31st and ends on Sunday, September 1st. Each night we have a big headliner, Friday night we have Drake Milligan. He's an up-and-comer, but he's been playing with Cody Johnson all over the US and in Europe. Saturday night's headliner is Jackson Dean. You've heard his songs all over the radio. Sunday's headliner is Craig Morgan. He's 90s and early 2000s. Everyone knows his songs International Harvester and Redneck Yacht Club. We've got a Sunday morning jam of faith where we've got First Baptist Youth Pastor David Christ doing a sermon with some gospel music by Cheto Kief, and that starts at 12.15 on Sunday. We've got over 20 food vendors this year. We've got every kind of food you can imagine. We have camping for tents, camping for RVs, campground opens at 3 o'clock on Thursday, which would be the 29th. This is the fifth year of the festival, and we're really looking forward to a huge crowd again. So single day tickets are $85, and that's for whichever day you go. That's Friday, Saturday, or Sunday. So if you go on Saturday, $85, that's $13 roughly a band, which is a pretty good cost. If you want to go for the full weekend, it's $179. Camping is extra, $100 for RVs, and $35 for tents. We get a surprising amount of locals who camp out for the RV. They kind of want to get away even though it's close and they don't have to go very far. So we have a lot of locals who drive their RV down there and actually will run home on Saturday morning and Sunday morning and shower because we don't have shower and water and power facilities, but it gives them a place to crash after partying too hard, late into the evening. VIPs are sold out. We expanded it this year from the last year, but it's still sold out. So that's always been a pretty good add-on for people to be up close to the stage. This year we have some VIPs seating as well and a few other add-ons for the VIPs and that sells out every year. All right, we're going to be talking about more Farm Jam again tomorrow. The accident happening on Aladdin Road near Pinkney City that happening about 6.30 in the evening. A two vehicle collision appears to be a head-on collision, a fatality in that accident was a Charles Felisir, he was going down the highway in a Volkswagen Beetle, was in the wrong lane and was struck head-on. He was deceased at the scene. The driver of the northbound truck was Smitty, Hagopian did not suffer serious injuries in that collision, indicates that he was en route home, Hagopian indicates to investigators that while he was driving he saw the motor home nearing him in the opposite lane and then a Volkswagen Beetle came out into his lane. He said it didn't appear like the vehicle was passing because it was not gaining speed and the action of going into the other lane didn't look like someone who was passing rather than someone possibly falling asleep. Now Smitty says he slowed down, eventually had nowhere to go, locked up his brakes and that caused his truck to skid straight ahead into the collision. To ensure fair trials, the Supreme Court of the United States created the Brady Doctrine Obligating the prosecutor of every case to investigate, gather and disclose all information about any individual upon whose testimony they will rely. The Brady list is a definitive public-facing platform of record for information about officer misconduct, de-certification, public complaints, use of force reports and do not call listings and more potential impeachment disclosures. On August the 15th the Stevens County prosecutor informed a Colville police officer Julio Valencia that he is being placed on the PID list maintained by the Stevens County prosecuting attorney's office. The letter along with supporting documentation and a declination letter is going to be maintained as PID material. Now being placed on this list does not automatically impeach a witness, whether or not the material is admissible at trial requires a ruling from a judge, but this potential impeachment disclosure is required to provide material that should be recognized as conduct that creates the potential for impeachment of a witness. This all revolves around an investigation from the Stevens County sheriff's office where the prosecuting attorney has decided there was no criminal act for the conduct. The state views the conduct that could create potential though for impeachment. It's a number of aspects of conduct. Number one, the prosecuting attorney says the relationship started based on you responding to a call in your capacity in law enforcement. The female in question still in high school had been reported as a runaway. After she returned home you initiated contact with her through social media and a relationship sexual in nature progressed. The letter to Valencia continues that you engaged in a personal sexual relationship while on duty. It is presumed that you are to be available at all times while on shift and engaging in personal business while on shift in the least would be a misuse of city resources. The potential impeachment here lies in your willingness to engage in personal sexual conduct while on the clock for the city of Colville in your official capacity as a law enforcement officer. This creates the appearance that you may be willing to steal time from your employer. This is what the Stevens County prosecuting attorney in a formal letter written to officer Valencia indicates. He says to conduct personal business calls into question your reliability and your decision making in the fact that you made the choice to pursue a relationship of sexual nature with an 18 year old who is still in high school that you initially came in contact with while responding to a report of a runaway. The impeachment potential is increased in the event of an investigation into a sex crime due to the potential for the appearance of bias. Further there is the appearance that you took advantage of your position within law enforcement to engage in a relationship sexual in nature potentially being dishonest about your relationship status in order to appear more available to the female. You engaged in sexual contact with also the investigative materials could be viewed that you exceeded the consent of the sexual interaction with the female. The prosecutor's office says they have to evaluate every case that relies solely on an investigation conducted by you. The effect of this PID material will be reduced by the use of body cams. If a case becomes based solely on your testimony with nothing to collaborate your testimony it may be problematic for the state to proceed depending on the nature of the case. And given the nature of the PID material the defense counsel is likely to argue that the conduct specifically relates to engaging in a sexual relationship while on duty relates to honesty. It will be up to the court to determine if it would be admissible impeachment material at any trial in which you are a witness. If the court ever does rule that this evidence would be admissible at trial for purposes of impeachment the state may never be able to call you as a witness at that point. So that was the letter going to a Colville police officer who while on duty was having a sexual relationship with a high school student. This all began back June the 30th. That's when the Colville police department were advised and became involved. Since that time this officer is still actively on duty for the Colville police department. The Colville police chief the Colville mayor they have both opted to take no action against this officer. A little more about what has gone on the Colville police department was aware of the situation back in June a rape kit was taken at Mount Carmel hospital ultimately was secured as evidence. When the Colville police department first became aware of the Valencia incident indications are that he was placed on administrative leave that day on his shift. It's unclear when officer Valencia went back to normal duties no word from the police chief. The initial report came from the father he said he felt his daughter had been taken advantage of due to her recent vulnerable state went on to say that he had caught his daughter having the relationship with officer Valencia he advised that he had discovered information on her Google account that revealed that they were involved in the sexual relationship and advised that his daughter was at her senior year of high school and that she was 18 years old. He had seen text messages relating to having sex about a week prior. As well as on June 30th and June 30th it was when Valencia was on duty the first contact with Valencia regarding his daughter had occurred sometime in April when he had reported her as a runaway Valencia met the father took the report back in April and then later when she had returned home officer Valencia had met with her in Colville to check up on her said he had learned that sometime after the check up that Valencia then again messaged his daughter on tick tock and then that sparked a sexual relationship the filed reports also indicate both the pictures messages and a cash transfer from officer Valencia to the 18 year old for a plan B medication while on duty officer Valencia had gone with the victim to the Colville Police Department's firearms range area and that is where their intercourse took place. The 18 year old also stated to Stevens County Sheriff's Office that she was worried that officer Valencia had done this with other females due to his knowledge of the range as a lot to have intercourse while on duty. She did give the Stevens County Sheriff's Office permission for her phone locks to be disabled so information could be extracted. There is a time there is a place where a community has to put trust in their police officers when a police officer takes advantage of a distressed young lady still in high school his basis of authority his badge his gun his position puts him at a total unfair advantage not the type of officer that we need in any type of authority position the officer acted badly irresponsibly the Colville City Police Chief and the mayor have acted totally irresponsible in having an individual still on the police force still interacting with youth down at the northeast Washington Fair in police uniform it's wrong.
