But if you want to talk the websites there's very easy to find JQK law.com and I'm here to take questions to I mean like anyone whenever we get money from anybody. So first we have a video consultation almost all time the video conversation on myself. So you're going to see me and hear me or maybe my associate attorney on your sir gave up. But you shouldn't randomly talk on the phone and send a thousand dollars that doesn't make any sense, especially without checking out some stuff or having you know websites don't make any sense like it's just it's kind of out there I'm surprised that I'm not going to get fooled by this but again it does happen. And you know lawyers are not allowed to reach out to you for clients I can't come on the internet on Facebook and say hey contact me that's illegal for lawyer to do that. They say hey contact me if you post on my website and my TikTok say hey how can I contact you and say if I can't go on some random website and say I could help you it's soliciting every every bar in the United States has a it's against a law to solicit clients because they don't want people abusing the system. So if you're someone lawyers listening to you that's a red flag and we don't do that because there's no reason to do that we have much more contacting us anyway. So that's a long and short of it I want to share that for a jump into it. But yeah let's get your questions just quick if you're on TikTok watching if you ask the same question over again we're going to mute you because it's annoying. Alright first question mode on a regular CS as I applied for I won 32 years ago and waiting for an MC interview is it worth to apply for tourist fees if my wife she registers for conference in the United States. Is it worth is it worth the time and the money to do it for yourself that's all I could say so it's a worth is a personal like a decision of what's worth and what's not. If you give it a shot do it it may happen it's not impossible, but I can't really set worth this value is in the eye of the holder. If they entered without permission to fix it up so it looks like the entry with permission because that gives them a chance to file for a green card in the US based on marriage to a citizen if they meet the other requirements of the process is called keeping families together in place program PIP KFC or KFDPIP slot of initials but that's what it is we've probably submitted six or 70s cases and very, very good families I'm happy we're able to do it for him. Geraldine says please if your case says correspond to his reviewing says 2016 what can be done. I don't know maybe your case is one that's going to take forever anyway so that doesn't matter but if it's inappropriate call USCIS and if they don't give you a good answer then contact the Congress person or if you really want to push it sue. But I don't know what kind of case you have, like if it's a case of your US citizen applying for your sibling, I have cases like that says 2016 it takes so long that that just happens. Now it says good night can a conditional green card holder travel to a foreign country without your spouse yes there's no requirement to have to travel with your spouse. So I think for joining Mike says, do you know a good post conviction relief lawyer in Northern California how do I find one I don't know in Northern California but I want some California. Wow so a lot of people in the group get to see all traces as I applied a year ago for a visitor visa but got denied even though I have strong ties to my homeland. How long shall I wait to reply there's no timeline to wait it's just really luck because that's about it. At nine nights I serve my mother green card holder and she applied for me in 2021 how much time do I need. I don't know exactly if you go to the visa bulletin or general timelines but they're not helpful. If your adult unmarried child that could take nine years to be faster can be longer. Jose Nas my mom is nine years old living abroad for 22 years with her expired green card. She found I-47 and I started a new I-34. Yeah that's probably the thing to do. Technically I better to follow I can't say it's better. I-407 means formally abandon your green card to the government but when you do that it may trigger IRS coming after him so that's one thing I'd be wanting to care for love. And based on your name you might be from Iran so there's some of those things you want to schedule a consultation private to warn you of all the risks involved what you're doing but probably inevitably just gonna file I want 30 just the green card case will be fine but I gotta sit and list all these potential red flags or issues like this for you so a private consultation needed for that it's not a good place to talk about it here. If I do it says can you apply for PIP if you have a removal order. I don't know the rules on that if you have a removal order or not now depending on how you enter the United States my little topic green card anyways but I haven't had any case that removal orders I don't think you can but I haven't read the regulations on that that far deep because I don't have any removal cases. Joe says how long did it take for the response request for evidence based on I-360 boards decree there's no fixed timeline for responses to anything from the government so sometimes there is but in this case what you're talking about there's just whenever they get around to it. Now that's the thing is too long it's like you know six months nine months 12 months you can try contacting USCIC what's going on. James Moody says how long is the average time to bring my son here I'm a naturalize us in the Vietnam depends on how old your son is if he's married or single and his background stuff so I can't say that. So Sarah says how much time to take the schedule appointment embassy the Google says takes two or three months of Google isn't correct the Pakistan embassy is not about by taking one to two months two years, one to two years. Joe says if I 30 approved can I 45 be denied yes there I 360 is looking for one set of things and the I 45 looking for another set of things so you can have one approved with the other denied that they're on the stern extended unrelated they're looking for two different things. So that says I'm a stem student tell me how the OPT works and how many chance I have for h1b so once you graduate as F1 student visa holder you have one year of OPT optional practical training if you haven't used up your CPT curricular practical training as a full time employee that time. Also you got to file your paperwork properly that sometimes doesn't work out and you get you lose out, but when they one year is nearing end if you're have employment with a company that does I nine verification e verify that's related to your field. So that gives you three maybe four years depending on what part of the year you're at to apply for the h1b. And if you're stem in your schedule that you're doing something creative or cool enough or you know you have a PhD maybe just file for green card who knows. Jojo says what's the timeline processing for green card holder applying for a spouse in the state of Texas. It varies I don't know if you're green card holder citizen Jojo but could be six months could be two years if you're a US citizen. Tracy and thanks I'm good at you to Tracy and why I said I answered why it's question our work says why I got a notice cases reopened after we see approval letter for I 45 sily. And that's in the race department see what the notice says once you get it. The user force says divorce after 10 years green card five years additional for citizen test those days count for what from when. When you got your green card you can file for sitting in the ship after five years that's that's it. How long does the I-45 take after approval there's no timelines. There's no timelines. Brozuka says why is the I-61 taking so long the government is not putting resources towards it. How many says after how long national leaders center say interview letters there's no fixed time depends on the embassy and luck. With son says I'm a F1 student with sister as a pack on my F1 sister has passport I'm on F1 sister has passport is it smart to ask for change of status. If it's appropriate I can't I don't know anything about you or your sister what you're doing or what change of status looking for this is not something I can answer based on like two pieces of information. The an era says can I go to from DACA to E.B. to national interest waiver I want to get a master of stem and have doctors as I was 16 have bachelors. Since you've had DACA from 16 you haven't accumulate a lot of presents today so it is possible but there's a lot of factors because your case is going to take a couple of years even if your N.I.W. is approved. It's going to take a couple of years before you have your interview at the embassy and who knows what's going to happen is your DACA still there the protection so there's a lot going on there so. It's not impossible but it's just too many wild you know things that could happen because it's going to take several years and that time the world go upside down who knows. Why the dates are backlog because there's a lot of people applying for benefits and there's not enough resources or a limitation on annual visa that can be issued. Samira has documented qualified how many months interview I answered already is not clear. It's just the time my questions are coming. My wife is a U.S. citizen and she filed the I-130 in August 2023 at the Nebraska how long for MBCU okay so you'll probably get approval if you did a good case at a month or two if not less and then you got away from the case you transferred to the National Visa Center. Probably another three four months but it could be longer it could be shorter and then you still got to do the embassy and so it's probably another six to nine months at least baked in the cake of your case. Dea Neera says I did AP and have legal entry also even to an IW question. The AP doesn't really help out unless you are married to a U.S. citizen. You still you still won't be able to adjust status because you haven't maintained status. It doesn't work out you haven't maintained status so that prevents you from doing it. In AP as a fixed it as per INA 245k it's kind of technical you'll still need to leave the U.S. and do a MC interview. That's bluebell says you look tired yeah I am I'm exhausted but I make sure I show up on these interviews. I see it myself too. Alia says what's the normal timeline for U.S. citizen applying for Spouse Winker who's been in Spondaca. It depends on what's going on but there's no normal there's no normal immigration but recently we've been getting cases like this done in three to six months. But it could be if it goes a year and a half I wouldn't be surprised that's that's the immigration department. It at least that says how long Islam might forever. Well I 45 be denied even if removal was dismissed. I don't know I got to see what's going on. There's other factors involved in your case not just remove orders we got to see what's going on. Broska says Canada DHS as Supreme Court did the MSPIP judge decision. There's appeal there's technical stuff they could do but they're going to let the judge make a decision first and take it from there. It's legal procedure kind of stuff. You're welcome day on day on era. Do you work with Afghans about the visa we don't do the Afghan cases that have particular problems or history and stuff that we don't specialize in. Emma says how long to take for Spouse the visa to USA when my son wife live works in Dubai. The embassy now with always backed up it depends on how you're doing the case and if you're doing direct filing or not. But it's a basic case like the typical way people do it which I'm not sure if your case is typical case like that probably take two years. Jenny says after approval 1300 when interview came there's no fixed timeline because whenever they get around to it. Let's see. You're welcome Geraldine. Sad Shizari says is there a way to speed up the visa interview because about two minor kids are leading the USA with their dad. They both are nine. You could request an expedite or something like that. That's about it. Joining says I have the previous out on three case that says correspondence is reviewing since 2016 they have a current pending vowel. Can I still regard the previous out on three case. I don't know. I can't. I don't want to have the previous case. You have vowel now the vowels a whole different case. I have to sit down and look at your documents with me and answering that. She knows is did biometrics and may how long for work permit. There's no correlation between biometrics and when the work permit's coming. Sue IMDB says or asks. How long is my sister sponsored me? She's a citizen from Malaysia 1520 years. You're welcome. Emma. Can you change your embassy of interview? What's the process? Depends on what kind of case green card case or tourist visa. Like a non-immigrant visa. Non-immigrant visa. You got to apply a new place for a green card. You have to be residing in other country and legally. If you don't sometimes go accepted but mostly they won't. There are always exceptions to everything but typically you can't change it unless like if you're from Iran you could change between Abu Dhabi, or Yervan, or Ankara. If you're African you can change it but typically it's what country you're lawfully residing in. Snatch Queen says hello sir. Any chance now for me tranadian my husband Bahamian and my 10 year old USA citizen son of Migrates. You got to apply for some sort of visa. That's it. You're welcome bluebell with Garst Natch. But yeah I mean like just any chance and everyone has a chance. There's green card lottery. You might have an investor visa of some type. You might get employment here. You might be a national interest waiver person. The directional work or a short ability but you know it depends. Brozka says have you ever seen the CBP rescinded deportation? I talked with CBP regularly at least the LAX office here. And it has happened where they rescind what's called expedited removal. But it's one out of a hundred thousand. It's got to be a real big mistake and they got to be nice stuff to do it. As soon as this can you help well we have a consultation to see if there's some exception but I mean I can't guarantee anything. Probably not going to be able to do anything but we can talk about it. Sashimi says hi just to ask about the SSN social number. Why is the Social Security Agency kept on asking for online application SSN. I don't know what that's they do. I'm not sorry immigration unfortunately somebody didn't mess up. Sashimi say right applied it to the S 360 and that's up to them what their rules are. I'm not sure what Social Security office does. Sashimi says she did medical exam three weeks ago but now received interview letter. That's just the way I don't know that's the government. JQC says how can my son adjust. I'm an LPR my son has a petition but under derivative but no approval yet. If your son's lawfully in the United States and not somebody who's in a sort of 90 day rule or something like that. And the case is current for filing within the United States to fall for adjustment. There's a lot of factors involved there. So I need to have a consultation session with you and your family, your son frankly. The I-130 petitioner is in your son and just see if there's some sort of exception or whatever. But there's a lot more info needed. Lily says smart to expedite a case if you have minor and living alone will mess up your order in line. I don't know. There's rumors that say if you press an expedite and it's not approved that does mess up your line ever see proof of that. That's what people say. If you want to give it a shot give it a shot really. Puthia says can my mom have a translator for a citizenship test if she falls within one of the exceptions. She has some sort of mental disorder. She's had a green card long enough and lived in the United States long enough. She's above a certain age. You got to see if there's an exception. But it's not a typical thing that most times they don't allow. Lily says my husband and I own a house together share car insurance the bank account we use weekly. And the interview felt that wasn't enough evidence. Sorry to hear that. Sometimes you get a bad officer like that or you just got to look more into your casey what's going on. As Zuka says I got I've got my rescindage I worry going back to my homeland for the I-6-1 is approved before pit. I don't know what you got rescinded and I can't tell you what to not worry about. I got to see what's going on with your with your case in private. That's like too much responsibility to say this or that. At least is it typical or we just get not get a great interview. Probably did. I don't know what happened. I was like not typical what you're telling me. I don't have to review it for myself. That's unfortunate. This happens. Okay. Blue Bell says how long does it take when a US citizen father applied for I-1-3 for my daughter is probably going to take 10 years. User 35. Good evening. Good to see you. Brazuka says thanks. We have to see what her status is or background is how she entered how long she's been here. Potentions you could adjust the status based on the data finally needing accepted by USCIS. Tammy says I did a biometrics when you're now no work permit, marriage based contact USCIS. Ahmed says my wife has been complete if national visa center. Wait for interview. Maria says mom had me in the U.S. but didn't pay the bill now 21. She hasn't denied visitor visa. Can she still get a green card? They're going to deny her for visitor visa for this or even if she had a visitor visa in mind to not let her at the border. For the green card there's no official rule that says they could deny you but they could figure out some way. I mean I'd give it a shot. I'd have to research see if there's some sort of official rule that they can. But they can easily deny tourist visas for this issue for not paying the bill for that. But I mean they got a for green card is harder. They have to have a reason to say there's no sort of fraud involved or something like that. Most likely it's okay. I still give it a shot because your mom is not going to be getting a tourist visa or a lot entering in the other way unless you go for the green card. I'd have to research in more see what's going on with you to see what's happening. But you know sometimes got no choice. Give it a shot. See what happens. All right. Good flow of questions. Like I said, how long is the process for K1 from Visa on hand? It could be a year, more like two years probably. Free for a K1 from Philippines. Because I mean, it could take six months to 12, six to 15 months for them to believe you're really a couple. And then it could take six to 15 months from schedule interviews. So it could be really lucky a year, more likely probably two years, unlucky, two and a half years or something like that, two and a three years. Jolene says my sister has a pending album with 30 because her husband wrote immigration that she paid her money for the papers, which is a lie. Can't I6, one wave that? No. Marriage fraud, there's a fighting marriage fraud. Six to one can't wave that. That's a mess up situation. Now, people, we had divorce, accused of all sorts of stuff. She's got to look into doing a vowel case and challenging it. But that's a marriage fraud is a serious one that prevents you from getting any joint benefits, any kind of immigration benefit. A vowel says, "If I overstay my tourist visa, it will affect my family that also tourist visas come visit." I mean, they could potentially deny that visas are not on the board knowing that you did that. Probably it's not going to happen, but it's not impossible. Yaw says, "I made a mistake with my I-485 forms. I used a receipt number for the I-130 instead. I made a mistake for I-45, I don't know what you mean by that." Vanessa, "Hi, friend. I have to see a Yaw says made. I made a mistake for I-140, I used a receipt number for the I-130 instead. I'm not sure what you mean, you used a receipt number instead instead of what. That doesn't make sense to me. S says, "My dad doesn't make any money. Can we use some L sponsor, my younger brother?" Yeah, you get it. It's called a joint sponsor. They have to show their taxes, their income, all that kind of stuff. But for a family-based case, that's what you're talking about. You can't use joint sponsors. Bond says, "What should I do if I don't get HIV approval on time?" I don't know. You got to find some other way to get here. Although, it says, "Can I file UVs after file for asylum? If it's appropriate, you can always file for UVs, and I'm not a bad idea. I wish you needed a proper case." "Can I file my I-751 without a lawyer?" I mean, you don't have to have a lawyer. It's not against a lot of file without a lawyer. I sent a file on a lawyer, or you probably should have a lawyer, but I understand it's expensive, but it's not wise, I would say, to do that. But if you want to do it, it's not going to stop at you. Again, we're here live every four p.m. Pacific time taking questions by U.S. Immigration. General questions. CryZX says, "Does the K-3 really trigger quicker? I want to do the approval of your point of view one out of five times." Ron, he said, "What are your thoughts on pro and place? Will it move forward?" Probably. "What do I have to do to file to renew my green card? If it's a two-year green card from I-751, if it's a 10-year green card from I-90 to renew the green card?" We come a member on the team. I'm not sure what the membership does, but hey, if you come a member, why not? Again, I don't know what it does though. Yeah, it says, "I filed and filing the I-485 forms. I read the receipt number for the I-130 instead of that, the I-485. If you're filling out if I-485 form, you don't have the receipt for the I-485, so this still doesn't make any sense to me, out of the team. And Geraldine says, "I appreciate it, sir. You're welcome. I wish your sister the best. It's probably okay, but it's a massive situation to be in. The force itself is hard enough, let alone the spouse, former spouse, doing that kind of stuff to you. But hey, it opens up a vowel claim, because this is the crazy person I'm making on false accusations. Let's take out some sort of proof of what they did. Is there a charge for my I-90? Typically, I-90s have charge. Go to uscis.gov and check out the fee calculator for fees related to any case. All right, let's see. Valerie, thank you for joining us. Let me see. And how much does it cost to hire a lawyer to carry a asylum case? Approximately. I added this-every lawyer has different prices. We're going to talk about pricing here. Sublime says, "What about if the MVC's website says your request? Can I be processed at this time?" I'm not sure why the MVC would say that or what your request is in the first place, Sublime. So that's, like, nine of information. One thing I was going to say, if you schedule a consultation office, you will have a video consultation almost always with myself or with my associate attorney. If anyone tells you to pay fees and just talks to your phone on WhatsApp or emails alone to pay other than the consultation fee, to pay, like, or send a contract, it gets a contract or something like this. It's not me. We don't send out any contracts or collect attorney fees without seeing me talking to you by video. Unless there's a consultation fee, which does not want to feed, but, you know, it manages what it is. And you pay that credit card. So if it's a fraud or something, just challenge it or something.
