He's claiming that he wasn't even that drunk, but he was there with his 10-year-old son. - What they're gonna come down to is, did they measure how much alcohol this person had in this system, right? Because he wasn't driving, obviously. He was at the restaurant. He was just having a good time. So, if there were objective signs or whatever symptoms that he was exhibiting that show he was very drunk, then maybe he could have an issue. But if throws that on kilo, he was just with everybody. Everybody was chilling. So, look, he's young though, nothing crazy. And for some reason, he got on his owner's bad side. Then he could have a better case to defend. The issue with the child endangerment charge though, that's a very serious allegation. And when someone is facing child endangerment charges, they can't potentially lose custody of their child. No munchies. - Wait. - What you're saying over at Luis is that, regardless of the situation, whether it be at a restaurant or no barque, if you are the only parent with your child and you get too intoxicated, the (speaks in foreign language) the police could potentially take your child away from you? - Yes, the theory behind it is that if you're the only person taking care of your child and you put that child in a dangerous situation. In this case, for example, you're intoxicated. He's in a public area. You're no longer taking care of that child. That could be argued to be a dangerous situation that you're putting your son or your daughter in. So yes, that's very possible. - But our listeners said it was a family party. He says he wasn't that drunk. - I think there's many good defenses he can make. He can argue that he wasn't that drunk and that the evidence doesn't show that he was so intoxicated that he couldn't take care of his child. We can argue that the child was never placed in a dangerous situation because the child was at a restaurant with a bunch of family. The child was always under supervision.
