I just wrote about this issue, this case in my recent book, because you have one of the largest censorship systems in our history, if not the largest, it's been called Orwellian by lower court judges. And what the court is saying is that we won't hear you on this issue because you're not the right litigants. Now, I have to admit, I've always been something of a standing dove. I believe that these standing decisions are too narrow, because they do prevent the court from rendering a decision on such important constitutional questions. So this issue will have to wait for another day. But one of the things that many of us have been arguing for years is that the government is engaging in censorship by surrogate. I testified about this in Congress, that they have made a mockery of the limits of the First Amendment by doing indirectly what they're barred from doing directly. They're using academic and corporate allies to bar and cancel and blacklist critics on a variety of different subjects. So it's going to be very frustrating for the free speech community, because we've been trying to see if there will be a final decision to strengthen free speech. The Supreme Court punts once again on free speech, and conservatives are absolutely livid. We're going to take a look at the latest ruling regarding the Biden administration's blatant censoring of American citizens and what it means going forward into November. In a stunning decision, the Supreme Court has sided with the Biden administration in a landmark case dealing with government involvement in social media censorship. In the 63 ruling, the court found that the plaintiffs in this case, yes, once again, lacked standing to sue. If I hear about the lack of standing one more frickin' time, I'm going to pull my hair out. Justice Amy Coney Barrett wrote the majority opinion where she asserted that the two states and the five social media users that brought the suit do not have standing to contest the level of coordination between government agencies, nonprofits, and tech platforms in restricting content on social media. Now, the background to all of this is several months back, Attorney Generals from Missouri and Louisiana sued the Biden administration over federal agencies working with social media platforms and third party nonprofits to censor conservatives online. About a year ago, last July, you may remember this, a district ruled that federal agencies could not communicate with social media companies or nonprofits with the purpose of trying to coerce them into restricting speech. That was followed by the Fifth Circuit in the appellate process. They, too, largely upheld the injection in the fall and found multiple federal agencies violated the First Amendment. Now, in addition to the Missouri and Louisiana suits, you had a number of doctors who believed they were unconstitutionally censored online for their opposition to coronavirus lockdowns. They filed suits against the Biden administration as well. All the plaintiffs were told, in no uncertain terms, by the Supreme Court today, that they had no standing in their respective cases against the Biden administration. A spokesperson for the New Civil Liberties Alliance, which represented the doctors in particular, issued a statement saying, quote, "The government can press third parties to silence you, but the Supreme Court will not find you have standing to complain about it," absent them referring to you by name, apparently. This is a bad day for the First Amendment. Now, the irony in all of this is that we all know what happened thanks to the Twitter files. I mean, you heard Jonathan Turley say it earlier. The government has been engaged in censorship by surrogate. This is beyond dispute at this point. We all know that the Biden administration and the deep state, the three letter agencies, in effect, deputized big-tech executives as surrogates to do what politicians being restrained by the will of the voters simply could not politically pull off. Increasingly, we began to see corporate boardrooms deliberately and dogmatically restrain the freedoms of citizens, particularly the freedom of speech and information, so as to maximize centralized control over the totality of political and economic life. One of the stunning revelations that came out of the Twitter files was how Twitter in particular, and big-tech in general, became a veritable dumping ground for former FBI workers. Mike Schullenberger reported that as of 2020, there were so many former FBI employees working at Twitter that they had created their own private Slack channel in a crib sheet to onboard new FBI arrivals. And to top it all off, not only was Twitter censoring you, but your tax dollars were paying for it. The FBI reportedly paid Twitter more than $3 million as part of their censorship efforts. It was too much for Elon Musk. He tweeted out bluntly, "The government paid Twitter millions of dollars to censor information from the public." And as of today, the Supreme Court declared that two state attorney generals and a number of victims of the social media censorship have no standing to bring their suits. To which we have to ask, who does? Who the hell has standing if American citizens subject to government-initiated censorship by surrogate? Don't! Now, obviously, this is rather black-pilling. It's pretty depressing. And I could totally relate. You also have black-pilled. I was some weeks back when we came under attack from YouTube and our content, our video content was labeled "harmful content." We got completely and totally demonetized. But gang is frustrating as all of this is. I can honestly tell you seriously. I ain't depressed no more. You may have heard a couple of weeks back. I was in Utah. And let's just say my team and I are working on something that is absolutely game-changing. All I can tell you right now is that this will be one of the biggest positive changes to Turley Talks that will benefit all of you. My fellow courageous and loyal patriots for years to come. Now, Rogan O'Hanley, aka DC Drano, is focusing a bit of on the silver lining in this ruling. He tweeted out, "There's a lot of doom and gloom about the six to three SCOTUS decision in Murphy versus Biden and how it impacts the First Amendment. You would like to quell some of those concerns." This decision reversed the injunction based on standing. SCOTUS said that without the plaintiffs having sufficient standing, they could not decide the case on the merits. The case is still allowed to proceed on the merits in lower federal courts as to whether the government violated the plaintiff's First Amendment right to free speech on social media. Long story short, this battle for free speech rights is not over. And SCOTUS will likely get further involved down the road. Well, I hope he's right. So what does all of this mean for November? I can only say thank God for Elon Musk. Seriously, the Twitter files revealed that it was indeed Twitter, even more than Facebook. That was the primary platform targeted by the government to crack down on free speech. And that platform appears to have been completely removed now from the government's influence thanks to Elon. So it looks like the game has changed significantly since 2020. We've got Twitter, we've got Rumble, we've got tons of platforms to get the message out. And we're already seeing that working. Trump is crushing Biden in the polls despite the legacy media's 24/7 attempt at sheltering Biden in every possible way they can. So while this ruling is disappointing, the good news is that the rise of parallel social media outlets that originally came out of the initial censorship shenanigans may indeed rise to the free speech occasion that the factlessness of the Supreme Court so pathetically squandered.
