What's up everyone and welcome back to the program in this episode we're gonna check in on Rex Huermann and the Long Island serial killer case and when we first heard about this case we heard that Rex Huermann's wife Asa Ellerup was not in town when these murders occurred well now there might be some issues with that whole entire narrative. And that's because the phone records well they don't match up and the reason that they don't match up is because the records have been destroyed so obviously it's going to be complicated to punch home their narrative the way that they were pitching it and of course that opens the door for Rex Huermann to you know say that there is reasonable doubt here that it wasn't him that they don't even have the phone records that they said that they had to prove that he's the man that they say he is so it's going to give him and his team some tenable ground but is that going to be enough to get this all tossed out and to get Rex Huermann off the hook I don't think so and the reason why is because the DNA evidence the way that they tied that DNA evidence back to Rex Huermann is pretty ironclad so I would think that with the DNA evidence they still have a whole lot to go on here but it certainly complicates things if these phone records don't match up so today we have an article from the Long Island Press and the headline some cell phone evidence hang up in Gilgo Beach serial killer case this article was authored by Timothy Bulger the same cell phone data that authorities use to arrest Gilgo Beach serial killer suspect Rex Huermann has also proven a complication in the continuing investigation which includes hundreds more electronical devices and remember he was using burner phones he had all kinds of throw away accounts as far as email goes so this is somebody that was using the shit at a technology and tracing all of that stuff back to him and pinning it to him is going to be very important to get this conviction Suffolk County prosecutors noted in court documents that there were several instances in which cell phone records no longer exist for the suspect and his wife due to cell phone service provider data retention policies that fact appears to have been partly the reason why a grand jury didn't indict Huermann on a fourth victim Maureen Brainerd Barnes until January until six months after he was apprehended in July he pleaded not guilty in that and the other three cases so he has pleaded not guilty in all of this and he says he had nothing to do with any of these murders however the evidence against him is overwhelming remember it's not just the DNA that they found at the scene his bugle swab meaning his cheek swab came back hot as well so when you add everything up in the totality of it all it looks real bad for actual men now does that mean that he's not going to have an out here does that mean that there's not going to be some kind of misconduct on the prosecutor side it doesn't I always leave enough headroom for that like we discuss all the time because we just don't know there's always that human component right and people screw up prosecutors defense lawyers all of it so I always leave the headroom and even when something looks like a slam dunk you just never know and a case like this one where there's been screw ups from day one I wouldn't be surprised by anything honestly unfortunately cell side records for the burner cell phones used to contact Ms. Brainer Barns were not obtained at the time of her disappearance and no longer exist prosecutors wrote in a footnote in the bell application that details much of the evidence against he orman in another part of the court filing prosecutors note neither cell phone telephone billing records nor travel financial records could be obtained for defendant he orman's wife asa Ella up for 2007 as such records were no longer available due to retention policies therefore it is undetermined at this time if Ella up was traveling out of state during the time of Ms. Brainer Barns disappearance and murder so why would the prosecutors say that she was a man? Does he have knowledge that that happened? Does he have some kind of evidence to back that up? Because if not, you know that Rex Uranman's team is going to sink their teeth right into this one. They're going to try and use this and harness this as some sort of tool to help them get Rex Uran in off the hook. It's unclear which wireless carriers he orman and his wife used but such companies generally retain that data for a few months to a few years. The footnote suggests that that fact complicated the investigation into the murder of Brainery's son is going to be able to get his son out of the house. It's an issue that may come up again as prosecutors said in court documents that law enforcement seized hundreds of electronic devices from the defendant's home and place of business. The filings also state that your men sell data that has been recovered has been used in a similar fashion as others which entailed contacting sex workers and searching violent pornography. The 60 year old Mastopico Park architect was previously charged with killing Melissa Bartholomew, Meghan Waterman, and Amber Costello, who were all found dead yards from each other in Gilgo Beach in December 2010, triggering the serial killer investigation. Police found the Gilgo 4 while searching for Shannon Gilbert, a new Jersey woman who had last been seen in Oak Beach in May of 2010, when they found the four women dead. That led to a larger search of Jones Beach Island that unearthed the remains of six more murder victims, including Taylor, who you or men hasn't been charged with killing. Gilbert was also later found dead in nearby Oak Beach, but authorities have suggested she may not be a victim of foul play, yet her family maintains that she was murdered. Now I've said it before and I'll say it again. I'm not too sure what happened to Shannon Gilbert. When you look at the whole entire situation and you look at her past history with mental issues, it sure seems to me like there was a mental break. But of course we don't know for sure. The official narrative says that she drowned, but it doesn't give us any reasoning as to why. Brainard Barnes, 25, a mother of two, who had been a straight A student, who later fell into drugs. She left her kinetic at home to spend the day in Manhattan, the last place she was seen alive. She told her family that she would return home the next day, but she never did. She disappeared on July 14, 2007, 16 years to the day of you or men facing a judge after being named as a prime suspect in her murder. And was found dead on December 13, 2010, near Hemlock Cove off Gilgo Beach. Brainard Barnes was found with a belt that had the initials WH or HM, and investigators have speculated that this belonged to Huerman. His grandfather's name was William Huerman, purportedly. According to the bell document, hairs found on Brainard Barnes' body were matched to Huerman's wife and his daughter. Huerman's attorney, Michael Brown, claimed that the DNA evidence is faulty, saying that Huerman is only a donor for this DNA. I mean, okay, sure. That's what his lawyer is going to say, but the test results prove something completely different. Two out of ten thousand people could be the donor, Brown said. NASA and Suffolk have three million people. That means six hundred people could be the perpetrator, and that's assuming that the DNA of the victims is that of the perpetrator. Well, I could be a football player, but I'm not. See where I'm going with that? Just because something could be true doesn't make it true. And if you don't have any evidence of any of these other six hundred people being the so-called Long Island serial killer, then that brings us right back to wherever you were, and that's to your client's doorstep. So how do you explain the evidence that has been compiled against him? He's going to say it's faulty DNA, but we all know what that translation is. That's the translation for loopholes and technicalities. And that's what happens when you don't have any evidence on your side. Suffolk County district attorney Ray Tierney declined to comment for this story, but held a news conference after Huerman's latest charges were unveiled. The task force will continue to investigate those cases, Tierney said, and when it's appropriate, and if we have anything to say, we will say it at that time, but we are going to let that investigation play out. The victim's daughter and Nicolette Brainerd Barnes told reporters the latest development gave her hope despite the delay. "For years it looked like there might not be charges filed against any suspect for the murder of my mother," Nicolette said. "While the loss of my mom has been extremely painful for me, the indictment by the grand jury has brought hope for justice for my mom and my family." Huerman, who has been held without bail and Suffolk jail since his arrest, is due back in court February 6. So he'll be back in court tomorrow, and obviously we'll get an update then, but as far as the court records go, when it comes to phone records, I don't know how much of a hindrance that's going to be for them to get to the point where they're looking to get. And that point obviously is a conviction when all is said and done. Either way, we're going to follow along, and we'll see what pops up because we all know that in cases like this, that shit crazy stuff always happens.
