ICYMI: Why NDA's Won't Help Diddy During The Federal Investigation

A Non-Disclosure Agreement (NDA) is a legal contract used to protect sensitive and confidential information shared between parties. It creates a confidential relationship between the parties to protect any type of confidential and proprietary information or trade secrets.

In the context of relationships, particularly those involving rich and famous individuals, NDAs are often used to maintain privacy and confidentiality. When celebrities or wealthy individuals engage in personal relationships, they may use NDAs to prevent their partners from disclosing any details of the relationship, including intimate details, personal conversations, financial information, or other sensitive matters.

The NDA typically outlines what information is considered confidential, the obligations of both parties to maintain confidentiality, the duration of the agreement, and the consequences of breaching the agreement, which may include legal action and financial penalties.Rich and famous individuals may utilize NDAs in their personal relationships for several reasons:

  1. Privacy Protection: Celebrities and wealthy individuals often value their privacy and may want to prevent any details of their personal lives from becoming public knowledge.
  2. Protecting Reputation: NDAs can help protect the reputation of both parties involved by preventing potentially damaging information from being disclosed.
  3. Preserving Business Interests: In some cases, personal relationships may involve discussions about business ventures or proprietary information. NDAs can ensure that such information remains confidential.
However, it's important to note that NDAs have limitations, especially when it comes to legal investigations by law enforcement:
  1. Limited Scope: NDAs cannot be used to prevent someone from reporting illegal activity to law enforcement. If the information covered by the NDA is related to criminal activity, the NDA may not hold up in court.
  2. Public Interest Exception: In cases where public safety or the public interest is at stake, courts may invalidate NDAs or allow individuals to disclose information protected by the agreement.
  3. Evidence in Legal Proceedings: NDAs may not prevent someone from disclosing information if subpoenaed by a court or required to testify in a legal proceeding.

In this episode, we learn why NDA's are worth less than the paper they are printed on when it comes to law enforcement, and how previously signed NDA's might come back to haunt Diddy.

What's up everyone and welcome back to the program. One of the favorite tools used by people like P Diddy or Jeffrey Epstein is an NDA and what they hope to do with these NDA's is to keep their deviant behavior under wraps now under most circumstances someone who signs an NDA is bound by it but when the feds come knocking and there's an investigation like the one we see cracking off in the puffy well those NDA's go directly out the window and today we have an article from Fox News discussing how the lawsuit with Cassie that has already been settled could come back and cause chaos for puffy with his new found trouble with the federal government so let's dive into this article from Fox News and let's see what they have for us headline. Sean Diddy comes accuser can't be silenced by non-disclosure agreements and trafficking probe this article was authored by Michael Ruiz and while an NDA prevents you from talking to the media prevents you from disclosing your relationship with insert person here it offers you no protection when it comes to the authorities whether that be the federal government or a local police force any potential non-disclosure agreement between Sean Diddy combs and his accusers or anyone else in his orbit who may have witnessed alleged wrongdoing would not prevent any of them from speaking with federal investigators eyeing the hip hop mogul in a sex trafficking investigation legal experts say they aren't bound by anything so they can sing like a canary said David Gellman the new jersey based defense attorney and former prosecutor who is following the case. They can speak because NDA's don't cover illegal activities. Yeah, they're only supposed to protect people's private life. So say you're having a relationship with somebody and you're some rich powerful scumbag. Well, you could have them sign an NDA and then you could sue them if they talked about your relationship. And why anyone would sign an NDA as far as a personal relationship goes is beyond me. Now, I understand signing, you know, a non compete clause or something with a company but an NDA basically stepping on one of your God given rights. Yeah, no thank you. You could take that NDA and you know exactly where you can shove it. Combs the billionaire founder of Bad Boy Records and Sean John fashion empire is facing a handful of civil lawsuits alleging sexual assault, trafficking and physical abuse while federal investigators have acknowledged that search warrants served on his mansions in Los Angeles and Miami were part of a sex trafficking probe. And any time you find yourself in that sort of conversation followed by any sort of talk about Rico, you know that you're in big time trouble. And that's where Puffy finds himself right now. Of course, like I've said several times, we have to keep in mind that as of now, these are just allegations and so far, no charges have been filed. But more times than not. And when I say more times than not, I mean the vast majority of times the feds aren't going to do what they did at Puffy's pad if they don't have the goods. So when you see them raid somebody's house like that, and then you see them take box after box of information, you hear these other stories that we've been talking about. And it leads me to believe that they have a lot more cooking than we even could possibly imagine behind the scenes. Believe me, the feds understand that Puffy's going to hire big time lawyers. He's going to bring in lawyers that are heavy hitters. So they better have their shit together. Allegations from the settled lawsuit against Combs brought by his ex-girlfriend Cassandra Ventura known as R&B singer Cassie could be a potential focus for investigators in the case said Derek Parker, New York City's hip hop cop. And the fact that there's a hip hop cop is insane. That all started back in the day when you had biggie and Tupac going bonkers on each other and bodies getting dropped on the West Coast and the East Coast related to that beef. So New York they instituted this whole last division and they brought on a hip hop cop and this dude's job was to deal with the hip hop community. Parker who wrote the book notorious COP about his experience and NYPD's rap related intelligence unit played a prominent role in the investigation into Combs after the 1999 nightclub shooting that left three people injured. And as we discussed earlier, Natanya Ruben, she says that it was Diddy who shot her in the face, but it was shine who ended up taking the fall. Now, Natanya Rubens has been very adamant that it was Diddy who shot her and she says she's willing to go to great lengths to approve that. And if that means taking fragments of bullets that are still lodged in her face out of her face, that's something that she says she's willing to do. Now, I don't know how much forensic evidence they could get off of a fragment that's been in somebody's face for this long, but with the way technology is grown and how far things have advanced. I wouldn't put it past them to be able to find something on those fragments. Now, with that lead directly to Puffy, I have no idea. All we can go on is what Natanya Rubens is saying and she's saying that Puffy shot her directly in the face. She already alleged some criminal acts right before she settled with him. Parker Tull, Fox News Digital, they could subpoena her about what she said, how she knew. Ventura's lawsuit, although settled out of court the day after she filed it, is fair game for federal investigators and provides a range of potential leads with its explosive allegations. And this is what I was talking about previously. Whenever you have these kinds of civil suits filed and there are these sorts of allegations made in these civil suits. It's inevitable that the federal government is going to become aware of what's going on and prosecutors in whatever district is relevant, they're going to have something to say more times than not about these allegations. And if there's basis for an investigation, then that's exactly what they're going to do. But what we see with Puffy is that that investigation has already advanced past a basic fact finding stage and gotten us to a place where there was a gigantic raid already. So they have accelerated their investigation here and there's no doubt about it. In her lawsuit, she claimed that Combs not only raped her and subjected her to physical abuse, but also blew up another man's car, regularly hired prostitutes and forced her to carry his gun and procure drugs. Congress also passed a law last year, making it illegal to enforce an NDA to prevent a sexual harassment or sexual assault victim from speaking out. Said Niamo Rachmani, a Los Angeles-based trial attorney and former federal prosecutor who has been monitoring the case. The allegations in a civil complaint are protected as well, which means Diddy can't really do anything to silence his accusers in a court of law. How to have fun. Any time. Anywhere. Step one. Combs staffers and bad boy employees witnessed some of the alleged crimes according to Ventura's civil complaint. And if those people had NDAs, they would be irrelevant in a federal court. Experts tell Fox News Digital. And in the wake of Ventura's lawsuit, other women and the man have come forward with allegations of their own. And legal experts say more accusers could emerge in the near future. And I think that's a foregone conclusion. There's going to be a lot of people that come out of the woodwork and there's no doubt about that. And of course, there's going to be people who are looking to profit here who had nothing to do with it. So we have to be very cognizant of that. I can't see the case just starting a case like this, doing a search warrant without going all the way through with it. There's no way Parker said. They're not going to just say, okay, forget about it. You go free. We're not going to bother you anymore. It doesn't work like that. And look, if it wasn't for the raid and we were just hearing about an investigation into puffy from some sort of leak, that would be one thing. But with the raid, it really knocks things into a whole last different category. And you have to start looking at it a bit sideways, right? And you have to start looking at it as if the government has something here. The rub, however, is even if the government does have something, can they make it stick? Another lawsuit on behalf of a Jane Doe alleges she was 17 when a longtime bad boy executive and an unnamed third assailant flew her on a private jet from Detroit to New York City to meet combs before drugging her. And taking turns sexually assaulting her. Flight logs could supply evidence in the case, and so could any of the witnesses who encountered the entourage that evening, including an unnamed recording artist and her parents, who were in the Big Apple Music Studio, when the traffickers allegedly brought her inside, according to the lawsuit. And this is why we go through all those court documents, so you folks know exactly what we're talking about in these articles and you've heard it directly from the accusers themselves. And then, of course, on the flip side of that, I like to add the responses, right? What's Puff Daddy saying? What's the rest of the Universal Music Group saying? What are the other accused saying? Because as of right now, we just have a whole lot of accusations, right? And to get to a point where we know if those accusations are true or not, we have to do the legwork. And that legwork, in my opinion, starts with those court documents. Despite the Federal investigation, Combs has not been charged with a crime and has denied all accusations of wrongdoing. In prior statements, he said the lawsuit with Ventura had been settled on good terms and that some of the accusers are just looking for an undeserved payday. When the feds get involved, they leave no stone unturned, Gelman said, and that's really where it's at. You're in serious jeopardy whenever the feds start knocking on your door, never mind kicking it in. And Puffy is learning that right now, so the million dollar question is, where do things go from here? All right, folks, that's going to do it for this one.
